Bill Cosby case: Judge declares mistrial after jury deadlock

A judge has declared a mistrial in the Bill Cosby sex assault case, after the jury was deadlocked for a second time.

The seven men and five women were unable to reach a unanimous decision, following more than 50 hours of deliberations.

Mr Cosby, 79, is accused of drugging and sexually assaulting Andrea Constand in 2004. His lawyers had argued the sex was consensual.

The US comedian could face new proceedings.

For now, he walks way from court a free man, but the prosecution has already said they are pursuing a fresh trial.

Take it you Americans have the double jeopardy rule? ( I think Scotland got rid of that recently and England doesn't have it) but it wont apply to a mistrial?

Mr Cosby could have faced up to a decade in prison if found guilty of three counts of aggravated indecent assault.

Dozens of women say he assaulted them, but statutes of limitation rules mean he was allowed to be tried for Ms Constand's allegation only.

Announcing the decision, the Pennsylvania judge reminded Mr Cosby that he remains charged and on bail, despite the mistrial.

Why just 3 counts I thought 100ish came forward?
Cosby has been the subject of publicized sexual assault allegations. With the earliest alleged incidents allegedly taking place in the mid-1960s, Cosby has been accused by more than 50 women of either rape, drug facilitated sexual assault, sexual battery, child sexual abuse, and/or sexual misconduct.

Earlier sexual assault allegations against Cosby became more public after an October 2014 accusation as part of an onstage performance by comedian Hannibal Buress went viral, and many additional claims were made after that date. The dates of the alleged incidents span from 1965 to 2008 across 10 U.S. states and one Canadian province

I'm glad that the prosecutors are saying that they will make a re-trial a priority.

A hung jury means that some of the jury remain unconvinced of his guilt. I guess that is testament to what the attorney of one of the women alleging Cosby raped her, described as " the blinding power of celebrity". There doesn't appear to be any other rational explanation to me. The creep was too scared to get into the witness box and assert his innocence - though that is understandable if you have as much to hide as Cosby. Cross-examination would be the last thing he would want. Whatever the eventual outcome, Cosby's reputation is now dirt with no prospect of redemption.

Let's hope justice gets it right second time around ...

I kinda half followed it - but wasn't aware he didn't go into the witness box. In many ways he reminded me of slightly betterJimmy Saville actually Rolf Harris would be a slightly better comparison

I understand the concept of allegations- mistrial not so much - double jeopardy a little

I doubt he is short of a bob of two (money)

In the US a jury trial is not considered to be completed until a verdict is given. Therefore the Double Jeopardy standard does not apply in a mistrial that results from a deadlocked jury. That leaves Cosby legally open to a new trial should prosecutors decide to pursue that path.

I dont think England ever had that.

I wonder if Cosby was some unknown black kid from a project would be enjoy the same presumption and result? Possible of course but some people would take an awful lot of convincing ...

If you're arguing that celebrity matters, I don't think that's in doubt.

If you're dismissing the judicial results so far as mere celebrity, that's your own assumption. Two lawyers and a judge picked this jury after questioning. More probably, there's legitimate doubt as some of this jury see the evidence presented.

Whether the prosecution thinks it can convince a new jury of its case remains to be seen.

Personally? I don't know--I wasn't there. But I DO get presumption of innocence.

Will it go to a retrial - I am not certain.
It should given the volume of complainants

But whilst I voted yes - I must also accept he is innocent

I think in Scotland we still have the unproven option - England doesn't have that I am certain


Not proven is a verdict available to a court in Scotland. Under Scots law, a criminal trial may end in one of three verdicts: one of conviction ("guilty") and two of acquittal ("not proven" and "not guilty")

These broads are a buch of fucking gold diggers. If they called the law immediately they would be told not to shower and they would be picked up to do a rape kit. they destroyed the evidence.

And this drug shit, they probably wanted the damn drugs. If a Woman says to you "If you get me some crack I will fuck you" is that rape ?

They destroyed the physical evidence of their own accord, that makes their claims invalid and even while the prosecutors keep trying to make a name for themselves I would be countersuing for malicious prosecution.

From day one. And I would do it even if I was guilty. If you want to prosecute me, do it in a timely fashion. To me, they look like gold diggers who want a big settlement, or possibly hush money tied to a civil case where the burden of proof is not as high.

Bunch of shit and you are all buying it lock, stock and barrel. I almost want to call you rubes in the colloquial sense but rubes refers to Rube Goldberg who was somewhat of a crazy genius. I am pretty sure he would never buy this horseshit.

I would buy them all dildoes so they can go fuck themselves. They are hoping for his legal fees to hurt enough to get a settlement. That is how it works here.
