While you can technically give prior consent to something that overrides your absence of consent at the time (ref. stuff like mental health directives, etc.), you might have a hard time selling it to the judges if things ever go sour, or if external parties report it. (Bearing in mind that a judge is a political appointment, not an avatar of Lady Justice.) Anyway. In my experience, at least, it gets painful for the penetrating party before it gets risky for the penetrated party. YMMV. If I missed your point, I'd sincerely appreciate if you elaborated on what you see as the danger.
