found this article sounds like they want to go after kink ......

The new squad will divert eight agents, a supervisor and assorted support staff to gather evidence against "manufacturers and purveyors" of pornography -- not the kind exploiting children, but the kind that depicts, and is marketed to, consenting adults.

Based on a review of past successful cases in a variety of jurisdictions," the memo said, the best odds of conviction come with pornography that "includes bestiality, urination, defecation, as well as sadistic and masochistic behavior." No word on the universe of other kinks that helps make porn a multibillion-dollar industry

This has been on hold for a while. Just before 9/11, the attorney general had scheduled a meeting of state attorney generals where they were going to discuss unified action against erotic publishers and websites. The attack derailed that for a bit, but it looks like it's back on track.

Those folks who think "this won't affect me" should learn a bit of history. When I was just getting involved in kink, agents of the postal service were opening first class mail looking for "obscene" letters and pictures and blackmailing people into turning in others.

It could happen again.

if anyone has any doubts, perhaps they should secure a copy of the Patriot Act and see how that document might assist the attorney general in such actions. there is no safety from the u.s. government and privacy is not necessarily what it used to be any longer.

This is exactly what this country needs, goddammit!!!!!

The government is putting eight guys on this? Christ almighty thats more than they threw at New Orleans.......

Write your congressmen and congresswomen and congresspersons and senators and senoritas......

Let's help 'em crack down on Dr. Laura, Dr. Phil, Pat Robertson and all these other fuckin' smut peddlers; can you FEEL me brothers and sisters?

Since this is the Bush Administration this program will get 0 funding I am sure. They only have a handful of agents but I think they are looking for busy body types to “snitch” on sites that offend the family values anti-obscenity types.
This sounds like a huge waste of time for law enforcement that has real criminals and terrorists to catch.

i'm so confused. the current law approving bodies (i think those are the senate and house of representatives) have approved the financing most things that the bush administration wanted (anyone remember that initial $50 billion with no questions asked?). i also think the patriot act has pretty much backed or fronted that as well. since when has this administration not gotten funding for programs they held dear? have they run out of money yet? surely they still have checks. maybe they are thinking about balances?

Well it sounds like from what the FBI agent have said in the article this program
it will divert resources and man power from other investigations. Bush won’t raise taxes for this so they will just have to stop investigating real crimes and hunt for porn using their existing budget.

still seems like they find one way or another to fund that which they see fit to fund. no balances, and the wrong kinds of checks. go figure.

The point though is that it didn't happen then, and won't happen now.

The more you point out failed attempts but the state to restrict liberty, the more effectively you highlight the systemic strength of democracy. Think about it - at some point in the past, it was conceivable that postal inspectors should snoop though private correspondence looking for obscenity. That is clearly inconceivable now – we have much more clearly defined, in a legal and civil sense, what the 4th Amendment says. That’s how democracy works: more freedom, more liberty, more respect for human dignity and life as time goes on. Democracy is systemically geared to protect the interests of the demos precisely because it uses the collective wisdom of the demos in selecting political leadership and choosing between policy options.

I’m not saying don’t lobby, don’t engage in political communication – political communication is the lifeblood of democracy. I am saying spare us the sky-is-falling hysteria, and the implied misunderstanding of democracy. Democracy, especially the US two party variant, is systemically superior to every previous iteration in political systems – it works. It’s disingenuous to pretend that liberty and respect for human life haven’t been increasing at a visible rate since the start of the Victorian era.

What is different here is how many small sites or amateur ventures will go under or close shop because of this. That's a huge number of internet sites. Sure, big companies have the hundreds of thousands of dollars to prepare to go to court, but the smaller operations, or those that didn't operate for profit, are better off stopping instead of risking persecution.

I don't know that there has been a similar case in free speech. The nature of the internet is that anyone can share information. Some of the best quality porn sites are not huge money makers or are just "side hobbies" for the people that run them. It isn't worth the risk for them to stay up if things start getting heated.

The latest casuality is insex (http://www.insex.com/main.asp), and they were a reasonsbly known membership site.

Once things start getting nasty, a LOT of amateur sites will go away. That's the saddest part of all of this. Sure, the big boys will stay and fight, but for those of us that have enjoyed free or near-free porn, better enjoy it while you can.

Parallel to that, on the other side of the pond, the British Govt. (using the emotional weight of a recent murder wherein the murderer happened to consume bdsm porn and tried to get out of the charge on grounds that the porn made him do it) are putting forth proposals to ban posession of some material that's already illegal to publish (the definition of publication including anything from simply giving the material to a friend to printing/distributing it on a wide scale). The stuff that's illegal to publish is pretty much any bdsm porn, but the proposals claim that they'll focus on "realistic images of simulated or actual acts" of GBH, which can be anything the jury says is GBH (as long as it causes any sort of marking). What's really surreal is that in the proposal documents they recognise that there's absolutely no link between consumption of "extreme" porn and criminal acts and move on to a thing suggesting that there are some images (even if they are fake) that are just too offensive, objectionable and immoral to be viewed by any members of society. Except censors, who have regular vaccinations to immunise them against the evil psychomongering powers of porn.

I think that is ignoring evidence that the current administration's and the last few congress' policies have had a chilling effect on freedom of speech. AAkasha cites insex, and though that is a site I've never much liked, they are an excellent example of repressing publication through threat of prosecution. I think the people who are promoting this atmosphere hate freedom and are anti-American.

Speaking as an American and a war veteran who thought at the time that he was fighting for the principles of freedom, I'm ashamed that most of Europe and parts of Asia are currently more free than the United States with respect to production, distribution, and sale of material related to sexuality.
