There was an article in the newspaper this morning where a couple who propositioned a 3some with a neighbor was arrested on solicitation of prostitution.  This apparently began when the police raided their place for other purposes, and the place turned up clean.  All that was found was some regular porn, a few downloaded (bittorrent type) non-porn movies and TV events on DVD, and a neighbor who when talked to mentioned the 3some invite, where the couple said they would give the woman a DVD of the encounter afterwards.  Apparently the women who was propositioned did not partcipate (or a prostituion charge would have resulted, none was mentioned), and she did not originally take offense nor press charges. The couple is now in jail on $10,000 bond each because of the invite.  Admittedly this location is in and around the bible belt.

I do admit that it really bothers me when I see these cases where the cops come up dry with whatever their original search intent was, yet somehow they piece together some alternate flimsy way to get what they came for (the arrest).  It appears the monetary value of a homemade DVD in exchange for the 3some was how they arrived at the solicitation charge.  From the tone of the article, the 3some invite was the more critical charge rather than the presence of the Napster-esque non-porn material.

Why I bring this up here is to ask whether the numerous profiles on sites like this where women seek a sugar daddy in exchange for her "taking care of him", or couples who offer a place in their home (something of definite value) in exchange for a young female slave joining the family would be in an equal jackpot as this couple?  Honestly, there is a type of "bartering" similar to that which has this couple in trouble going on here everyday in these profiles.

Are people truely careful and cognizant of what they put in their profiles?  What is the governing law here? Is it based on wherever the collarme server is located?

YOU must be very careful in theses small towns,we never play with the locals. You never know when johnny law will kick down your door , can you see the scene her/him tied to the rack and I am stuttering trying to say but officers this is a new exercises routine..smiles bounty

This sounds like something the cops around here would try. Granted i dont live in the south per se, but this area is a very conservative area, so i know i have to be careful with the activities i would wish to do from the BDSM side as well as my chosen religion.

Tell me about it Dincubus!! We live in a small town on the coast of Washington.  Not only are we M/s poly family (as if that is not enough), but we are also Wiccan.  (can we say "witch hunt"?)  We are very open about our religion and that we are poly... not so much about the M/s though...

Thank goodness for all the liberals and people into alternative lifestyles in Ann Arbor...

This raises an interesting question...do male dominants have to be more careful than female dominants? You have to admit, a vanilla person's reaction to seeing a male hit a female (or doing some other sort of dominant act) is likely to be completely different than if a female did the same thing to a male.

hmmm, interesting. yeah I think that is true up to a point.  Although I think over all, society has a bigger problem with FemDoms because alot of people still think of women being inferior.

What was the original search warrant for?

Just playing devil's advocate; the cops might be trying to take bad people off the street with this sort of tactic. 

That said it is as laughable as the other thread about the guy suing IBM.  I sure hope they don't get away with such specious arrests/prosecutions ... even if they should be off the streets.

There really isn't a law when it comes to this lifestyle.  While considered deviant it doesn't really violate any written codes.  (The exception that I have heard of pro-dommes being brought up on prostitution charges.)  That being said, if you run across some "arrest hungry" police, they can make a broad interpretation of a code and twist it in order to get who they want.

Interesting....some state laws make it mandatory for a cop to make an arrest if they arrive at a call and there is evidence that physical domestic violence has taken place, (that is marks and bruising on one or both parties).  By law they really don't have a choice about making an arrest.  I don't know how this could play out if the wrong cop walked in on a D/s scene. (ESPECIALLY a male-dom/femsub)  While I have never walked in on a D/s scene, it HAS to have happened to some of the  more seasoned officers.  I personally would not make an arrest if it was obviously D/s activities.

Ha! So is it prostitution when you pick up a girl at the bar? There's monetary value in drinks, despite their non-durable nature.

Same goes for a lot of relationships/marriages I've seen... the presence of financial support or gifts is hardly a non-monetary value. The vague nature of the law was not intended to make it allowable to apply prostitution charges to ANY sexual act.

Interestingly, she was not arrested but was hospitalized for therapy. while I am not familiar with all the facts here the news stated that he enslaved her, And forced her into prostitution. Niether the comments on the news story or the charges indicated in any way that it was not a consentual relationship. While in my opinion if as the police stated there was forced prostitution, well that I can not agree with, But it makes me nervious that the attempt was made to paint the M/s relationship as the root of the "evil"

There is a link to that story in the Pimp Slave Contract thread, and it clearly says that she was cited for prostitution.
I didn't see anything about charges of forced prostitution, or hospitalization.

Please provide us with a link those stories, since that would indeed put a different face on it..

This just sounds like made up bullshit.  Where did this happen, what newspaper are you citing?  When someone says "I heard about this crazy thing that's unbelievable,"...I don't believe it.

LMAO!![:D] I couldn't have said it better myself. I was thinking much the same thing... Such as:

1. What news publication printed the article?

2. When was the article printed?

3. Is there a web-site maintained by the publication?

4. If so, mind sharing the link?

5. What  State did this supposedly take place in?

6. What the hell was the warrant issued for?

There's just too much information missing, and much too leeway afforded these alleged police officers to give it much weight, so far as ringing true in my mind.

If they had a warrant for one thing, they can't just trump up shit and arrest for something the warrant wasn't about. They have (in so far as my knowledge of police procedure, which, granted, I'm not a cop, but I've dealt with enough and as a US citizen, do know my rights) to actually be able to "prove" everything out the way that it needs to be proven in a court of law. They can't just go on "Oh, well this neighbor says such and such, and therefore, just by way of hear-say, it must be true. Let's arrest those perverted pimps!"... *cough*bullshit*cough*

For one, even if they see something illegal, technically they can do nothing about it, till they come back with an arrest or search and seizure warrant for that particular illegality. IF it's in someones home. And they came there for something else.

The probable cause that they achieve by seeing it, first hand, might by-pass that, however, so there's my disclaimer, and I'm admitting that probable cause could have given them a go-ahead to search for something else, but according to the article, (allegedly) they found nothing illegal, and only turned up something sexually deviant (and mayhaps per chance, not even illegal) in the comment of the neighbor... So there wasn't a search warrant issued for anything other than whatever they were looking for, and that, they obviously didn't find (probably drugs)... Owning porn isn't illegal, so long as you are old enough by your states legal code (usually 18 in the US...).

This is also, mind you, all speculation from reading what I've read as well...

As far as I'm concerned, I don't think the cops should have made an arrest at all. I mean, that's idiotic, it's like me asking a woman "Hey, wanna come back to my place and make a kinky fuck video? I'll give you a copy too, so you can enjoy it later." And getting arrested for prostitution... OR soliciting. Sure, I (allegedly) offered to give her a copy of a produced video... Sure it (allegedly) had sex on it... Sure it might be of (allegedly) some sort of monetary value... But the concept and intent was (factually) not to pay her for it... And intent (factually), is largely what makes up that which is criminal, and therefore arrestable. The idea wasn't prostitution or paying (except maybe in my participation and her enjoyment) for the act.

Unless it's enforcable that they can't have threesome sex in that state, I don't see where the prosecutions basis is going to be. It certainly doesn't appear to be "prostitution". It also certainly doesn't have much to stand on with one persons "hear-say" as probable testimony. I won't be surprised if the (alleged) police officers don't end up getting slapped for false arrest, among whatever other charges might accrue from falsifying charges etc.

The idea that they're charged at all is outrageous (if that is allegedly the case) considering that if the cops only have one persons spit about the matter and they've no hard evidence, or even circumstantial... I mean come on... Someone saying "he did this, or she did that" is never grounds for an arrest... Simply investigation into the matter. And even then, police still would need to get hard evidence... As in "witness the illegal transgression" first hand. So far as I can tell, there isn't even any evidence that could be considered circumstantial.

I think this is so much bullshit, but hey... Dirty pigs do what dirty pigs do. And I'm not the overall authority on authority... LOL...

There are some states that still have archaic & rediculous laws on their books.  I think it is in Georgia, & not so long ago, when they passed it, that they passed a law saying a woman couldn't own a vibrator.  It was fine for the the men to own it.  I think too, it might be Georgia that still has laws against anal sex.  I am not sure.  All I know is if that is true, I don't want to ever go visit there, no matter how beautiful it might be.  I don't care much for anal, but I sure as hell don't want a law to tell me I can't do it.  Actually, one of the surest ways to get me to do something is to tell me I can't.

As far as the first couple who got picked up, when the government wanted the mob, they got them on IRS charges.  IRS fraud really doesn't hurt the general public directly, but those guys were locked up for a very long time.   In work, people who cause trouble for their bosses generally don't get fired for insubordination or for the trouble they are causing.  They are simply written up for the little things they do wrong, like being a few minutes late or not following a policy to the letter.   

I would be very interested in finding out if that couple was being watched for something else, or if it was just backwards, christian/religious morality laws.   We may never know. Very often that kind of information is not shared with the public. 

But law enforcement, our government & others have been prosecuting people using these methods for a very long time.
