AAkasha -> Dominatrix case on "The Law Firm" (8/3/2005 10:43:00 PM)

I just saw a preview for the NBC reality show "The Law Firm" on Thursday nights.

The episode this week has a client that is a professional dominatrix.
From nbc.com:

"Egos clash and tempers flare as a professional dominatrix battles a computer geek who used to be her friend!"

I think the message of the case is: Get your business relationship down in writing.

The hot-tempered geek that created her website claimed he was an equal partner and entitled to half the profits. She (obviously) disagreed. But since they didn't have any paper with both their signatures on it, and the domain name was his and the code was his.... he could pull the plug when he didn't get what he wanted.

I watched it. Rather boring overall, but there was some funny stuff. One of the lawyers said he wanted that case as he had experience with a Dominatrix. The Judge seemed very interested in seeing a copy of the website after he questioned what was available on it for viewing, even though it turned out to have nothing to do with the final judgement. Sounded like he just wanted to see some pictures! And they showed a bit of a tour of her dungeon, which was quite pretty!
This is a reality show. It was a real case and the dialogue is unscripted, so I thought it was quite entertaining.

I didn't see it (work sucks for that). However, I have two questions.

One, did anyone else hear the agreement?

Two, what state was it in?

The reason for those questions, is that most states consider verbal agreements as binding contracts. IE: If I was to say that I would pay you $10 to wash my car, and then didn't pay for the service, I could be sued for breach of contract.

I don't believe there were any witnesses to the agreement between them.

And I believe that Sabrina Belladona is in California, and presumably the guy was too.

I have a friend who was snookered by her web guy---for her fetish fashion line, not pro domming---and had to start from scratch when he bugged out. I certainly advise getting things in writing!
