Walmart is an evil beast, but this just goes to show that attorneys have all the power.

Then they weren't awarded enough. If the lawyers took more than half the award, leaving less than her medical bills to date, there was nothing left for the future.

I was lucky with a large corporation. Long story, but when I was laid off, I got a severance package I didn't really deserve. I suspect it was partly to keep me from suing for discrimination (firing because of a disability), but I didn't care. I would never have sued, BTW. Not worth it.

I'm saying that the insurance she had with Wally World should have paid for her medical bills; is that not what people pay the premiums for? And that she should have recieved compensation from the trucking company that, from what I can understand, were negligent in some way, to cause her harm. I don't see the two things as being the same, but I may not be understanding something.

Yay, good for you. Walmart is the evil empire, home of cheap plastic shit and made by child laborers and the cause of so much destruction for locally owned and operated companies. People need to be willing to pay a bit more for quality products that are locally made and not be so willing to fork over their money to that vile hell hole. I live in Maine and we had a long battle with the city council to not allow a Super Walmart into our town. We won, for now. God I love living in a blue state with people that care and are willing to stand up to corporate demons like Walmart. Keep it up and make it 7 years...

Yes, that is what people pay premiums for, but in this case, since it's a car accident, it should go to someone's car insurance, hers or the other driver's. At least that seems logical to me. I don't see anything logical in two insurance companies taking a hit so she can be double-compensated. Even if it is Walmart taking the hit.

I refuse to shop at Wal-Mart for a variety of reasons. The wage they pay their employees, Discrimination, the fact that they put Main Street Ma and Pop out of business and that they killed manufactoring in America that now has to go to foreign countires where its cheaper.

Just another reason why I hate Wal-Mart.

I dont see it as insurance companies being doubly hit. I see the money as her loss of future wages and care. Not reimbursement for medical.

no, Walmart simply wants to take the portion of the settlement that is owed to them for the insurance they paid out that has now been reimbursed.

her settlement INCLUDED reimbursement for the medical bills that were already paid. that money, quite frankly, should have been paid directly by the attorneys to the medical insurance company BEFORE the woman's portion was EVER given to her.

bottom line, Walmart is in the right here, and the legal team this woman had really did her a disservice. they did NOT settle for enough. but her family agreed to it. now that they actually have to pay the bills THAT THE SETTLEMENT CALLED TO BE PAID, they are crying foul.

this is NOT Walmart's fault.

I am shocked ....shocked I tell you...Walmart has the big smiley face, the friendly greeter, the constant pimping about how all their "associates" are like family...oh well fuck da bitch all I care about is low prices and the return of her $210,000 attempted swindle will guarantee me saving at least .02 cents on my next $10,000 purchase. Maybe WalMart can see if they can get a lean on their home and future earnings to recoup the whole amount. Maybe they can even get the judge to award them their attorneys fees also. With any luck they could probably use their influence to get her charged with a felony for attempting to scam them.
Just one more reason why we should all do our shopping at wallyworld.

I would be curious to know how much WalMart got after they deducted their legal costs? Ya know you just can't put a price on that kind of a public relations coup.

Booo hoo woe me, Im too stupid to read the fine print. First of all, they should have gotten a better lawyer since theirs took almost half of the cut, and the lawyer probably knew about the clause but wanted to make some money since his clients were morons.

Given the amount of negative publicity that Wal Mart attracts and creates, they should have let this family alone. The money in the family trust is miniscule to the profits the company makes on an annual basis.

They have a special 'fuck you' clause in their health insurance contract whereby Walmart can claim their money back from any potential lawsuit settlement an individual may get... apparently, according to Walmart's charming spokersperson, "it's in a spirit of fairness to their other associates [sic!] that the company recouped the money from their former employee", or something to that effect.
