This article speaks more to the humanity and individual initiative of local managers than it does to the benevolence of corporate management.
Once freed of the responsibility of getting permission from above the managers did what any responsible,compassionate person would have done.

"Until recently, many employers didn't vigilantly enforce the provision, and some states and federal courts didn't think the claim held water. But as the cost of covering workers continues to escalate, employers and health plans are getting more aggressive about going after the money. A Supreme Court ruling last year also has given them a clearer legal map to suing employees and winning."

It was also stated in the the article that she signed the insurance policy 8 years ago and had the accident 7 years ago.  I know, cold hearted way of looking at this but her medical expenses were paid by other people's premiums who paid more then they used.  That's how insurance comanies make money, they bank on people not needing the insurance.

Last fall a friend of mine's son got hurt at school.  Her medical insurance immediately wanted the insruance information of the school and proceeded to recoup their expenses as it was faulty equipment at the school that caused the injury.  I still feel that insurance is a nice coushion when we need it, but if someone is liable for our medical costs they should be made to pay it and let the insurance company pay for our sickneeses and illnesses that are unpreventable.

I work in retail.   I am disabled.  I am hearing impared/bipolar.  Sometimes it causes challenges. 
I know one thing.  I cannot afford our insurance.
There are a couple of things that bother me in this story.  Why is a disabled person stocking shelves?  I stock shelves, but not often.   They have me doing a lot of other things.
I don't think that is "fair" that Walmart could get anyone's claims back.  That is just bad business in my opinion.
I cannot help to wonder why this woman has so many problems.   I feel for her, but, Walmart is not responsbile for her insurance. 
If they were allowing other disabled employees a break on insurance, that would be a concern.
Since she sued the company, I lost any feeling I could for her.

She's not.  When she worked at WalMart she stocked shelves.  She now lives in some sort of care facility.

Wal-Mart is not going to look good regardless of how this one turns out.   Then that brings up the next question.  We really need nationalized health care of some kind in this country.   I hate to think what is going to happen to me when my family passes.  
I will figure it out. The estate will be controlled from here.  They will just have to direct deposit it.

Agreed, it's a very sad story, but if you make an "exception" in this case, why not the next one? Where do you draw the line?

Read the FINE PRINT. Lots of folks just sign the paperwork w/o even reading the regular print, much less the fine print, trusting that nothing like this will happen to them.

Really, their lawyers dropped the ball...if they had done the research then this might have been a factor in the amount of the settlement.

No they didnt drop they ball, they walked away with almost half of the settlement, but you should stay quiet this is a wall mart bashing thread :)

       Lawyers are like pro-dommes, they get to pick and choose among who they will get paid to fuck.  You don't just hire a lawyer, you have to seduce him/her by laying a complete case on the desk that lets him make 10 grand in 8 (legitimately) billable hours, without ever getting near a judge, or you sign the agreement on no limits or safewords.

     If you are stuck with the latter, then making sure they know exactly what you expect to have after the bills are paid is your responsibility.  This family signed the deal.  Did they even know what was owed, or just "reckon a millyun dollers'll take ker of us'n jes' fine?"


     Controls on contingency fees might help.

On one hand,  I'm glad that the corporate fucks at the world's "Company Store" took notice and decided maybe it was a good idea to actually show some (false) compassion.

On the other,  I'd like to personally perform the hapkido move known as "Plucking the peach" on each and every person on Wal*Mart's board of directors,  the CEO,  CFO, etc etc etc ... (partly) due to how long it took them to act even remotely human.

Thanks for reminding Me of more more reason why I refuse to shop at Wal-Marx (yes the "x" is intended). Reasons why:

-Its poor quality made in China stuff that you have to buy again when it breaks.

-It helps propogate a shitty company and an oppressive regime (Chinese towards Tibetans) through economic support of both evil empires.

-It gets rid of competitors by lowering prices, then jacking them up once competitors are gone.

-It replaces 1 f/t job with two part time ones.

-It helps treat their employees like dirt, inclding spying on them.
