WILKES-BARRE, Pa. - A judge known for creative sentencing has ordered three Spanish-speaking men to learn English or go to jail.

The men, who faced prison for criminal conspiracy to commit robbery, can remain on parole if they learn to read and write English, earn their GEDs and get full-time jobs, Luzerne County Judge Peter Paul Olszewski Jr. said.

The men, Luis Reyes, Ricardo Dominguez and Rafael Guzman-Mateo, plus a fourth defendant, Kelvin Reyes-Rosario, all needed translators when they pleaded guilty Tuesday.

Anybody who thinks Spanish-speaking people are stupid should take an interest in observing this one closely.

The article doesn't say if these guys are illegal aliens, on visas, or citizens.  I doubt they are citizens, because who the hell is born here without learning English?  So why aren't they being deported?

Havent worked this thing out yet.       So to noone in particular.

If you want citizenship in a country, first rule, learn the language.

Too many live in a country, never want to integrate, just take advantage of the benefits, mainly financial.  Then add, trying to impose there home philosophy.    Well if Your country and its rules are so great, why leave???

wut is englisa??? no speaka la englisa!!!

Kirata -> RE: Learn english or go to jail (3/27/2008 4:08:58 PM)

What struck me was two things. First, the reporter's headline summation, "has ordered... learn English or go to jail". Actually, the judge is offering them a "Stay Out Of Jail" card. And second, then the story ends? Like what, they're going to think it over? Updates to follow? I would expect those four men to take, collectively, about four seconds to look at each other and then say "Yes" together. I base that on it having taken me and a pal about two seconds to look at each other and say "Yes" together.

Olszewski said the language condition he imposed on the defendants, who are resident aliens, was not something he had planned. Once he saw all the translators in court for one case, the idea dawned on him.

Definition of Resident AlienResident aliens generally are taxed on their worldwide income, similar to U.S. citizens.
To be classified as a resident alien, the individual must meet one of two tests:

1. Green Card Test

A non-resident alien is a lawful permanent resident of the U.S. at any time if they have been given the privilege, according to the immigration laws, of residing permanently as an immigrant. This status usually exists if the Bureau of Citizenship and Immigration Services has issued a green card.

2. Substantial Presence Test

A non-resident alien is classified as a resident alien for tax purposes if they were physically present in the U.S. for 31 days during the current year and 183 days during a three-year period that includes the current year and the two years immediately before that.

Probably for the best, it would only confuse them.

My suspicion is that the judge believes their motivation for committing their crimes involved the inability to find legitimate economic opportunities and integrate into society.

And thus, if they will learn enough to be able to pursue them and then do so, he'll keep them out of jail.

Fair trade.

i lived in Alabama for a few years, and if a good grasp on English could determine whether or not someone could be incarcerated...a whole lotta "good ol' boys" are going down!!!!

There are adults who were born in this country who can't read or write, should we deport them?
Since there is no national language nor any legal requirement to speak English what is your justification for your position?
