Yeah he cost his workers untold amounts of time and money defending themselves from his tax evasion. That's a hell of a guy alright. The funny thing of course is that the next trial won't involve the workers, all acquitted, so his defense won't be able to introduce the "didn't intend to break the law" defense since he is on record quite a lot with his clear intention to evade paying taxes unlike his former employees.

The IRS has been more careful on who they persecute, excuse me, prosecute these days. They've suffered quite a few losses on tax evasion claims (with the defense arguing the constitutionality of the tax) in the past few years. They kept coming down hard on the high-ups of various anti-income tax movements (especially those who were ex-IRS agents) and lost all but one of them.

Tell that to Wesley Snipes, Kent Hovind and all the others serving time right now. The tax protesters have had a few successes by arguing jury nullification arguments but that is simply a crapshoot and sets no precedent and anyone peddling their schemes based on a jury nullification acquital is asking you to risk your freedom on getting a equally sympathetic jury or getting a no nonsense judge who won't allow the jury nullification arguments in the first place. Looking over the charges Kahre still faces it looks like a slam dunk that he's going to do 5 to 10 years after his next trial.

I don't know the specifics about Wesley Snipes, nor do I know his defense. what I do know is that if the court tries him again, my money is on Kahre. as far as jury nullification is concerned, I wouldn't call what the tax protestors do jury nullification as they are not nullifying any law whatsoever because there are no laws saying that you have to pay a federal income tax. the exact wording in the irs' book of pain is that it is an action of 'voluntary compliance'. in short, there is no law that requires most citizens to pay an income tax...and if they are not breaking a law, why are they being taken to trial?

This is why I have little patience for tax protesters. Voluntary in the way meant when discussing the income tax is a very precise legal term. It does not mean voluntary in the usual meaning. You've been lied to and you didn't even bother to check it out. To explain it simply the income tax is voluntary in the sense that it isn't confiscatory. That is you pay without the government seizing any of your assets as collateral. Here is a fuller explanation. In short if a tax protester is claiming anything about the income tax that supposedly lets you avoid paying the tax protester is lying.
