I'm not a lawyer, but I thought there were federal laws protecting whistle blowers.  It does seem ridiculous to me.  Alumbrado, I feel for y'all that live in Memphis.

Those laws work if you have already filed a formal report, and then document subsequent obvious retaliation, but this smells like an attempt to use records access for personal vendettas.

If this blogger were to suddenly have an unsatisfactory evaluation in their jacket, or several 'anonymous complaints', or their family were to be pulled over constantly, the gang sign flashing Mayor and and his 4th or 5th appointed Chief in as many years would just claim that they were the one's being harrassed by any questions.

MPD is working very hard to live up to the standard of departments like Washington DC, by throwing out the requirements on education and past criminal history, and New Orleans, (city council members just took the police human resources director to task for not hiring applicants...who never showed up for their interviews...).

Having a bad week 'Tip'? Or is a law enforcement thread something on which you can only offer hijacks, and zero knowledge?

Right after I graduated from college, I got approached by a MPD rep at a job fair.  My minor was in criminal justice.  The starting salary was about the same as it is for my home town, which only has 35,000 people.  I think their incentive for people with bachelor's degrees was about $5k more than the average starting salary, which is about the same as my hometown.

I got called by a NOPD recruiter 4 years ago, when they spotted my resume on Monster.com.  I told him the same thing.  Police departments like that are never going to get quality people until they are willing to fork out the dough necessary to attract them.

Oh yes, once we slack off on taking law enforcement to task for their intimidations...it will be the beginning of the end of the bill of rights.

We are getting a little complacent about this type of intimidation law enforcement is bringing across this country. People are being arrested and jailed WITHOUT CHARGE...only to be released in a few hours.

Speaking of D.C., 100's if not 1000's were arrested during a peaceful demonstration a while back and yes...WITHOUT CHARGES and then released. Upon being sued and losing in court...the city suffered nothing, no fines, no firings and no reprimands at all. Law enforcement is becoming emboldened when they suffer no consequences for acting like Nazis.

To answer your question more worriedly...this can happen with the whole country with recent laws allowing Posse comitatus.

Take a look at FEMA, the executive orders which have the force of law and that IT can take over the whole country and throw anybody they want in jail or a FEMA camp.

Are you going to do a better job of producing these laws allowing posse comitatus violations than you did with producing a record of Lincoln's combat experience?

All you have to do is Google this info. It is all over the net. Take a look at what is already staffed and available.

I said Lincoln 'saw' combat and one can 'see' combat without firing a round or getting hit by one. I know veterans who 'saw' combat, got the ribbons but never fired off a round or took one.

You said that he saw so much combat that he grew tired of it...what is all over the net (and history) is that he never saw any... unless you count 'attacking' an empty village.  Nice job making up a completely bogus definition of 'saw combat' though.

Sooo... posse comitatus was repealed when again?  (And don't bother with that 2007 defense authorization bill... that inserted wording has already been removed).

A metro police dept behaving badly?  Say it isn't so!

At least the bloggers have a sense of humor.

This kind of reminds me of NOLA after post Katrina, when Ray Nagan had the police go around and gather up everyone's guns that they could find. That wasnt an example of trashing the constitution or anything...

If it were only Nagin.

It was the National Guard, and the US Army plus the local police. Many were deputized by the local and state authorities.

All under the order of FEMA. Actually kept a few 100 and some reports said a few thousand in a civic center without food, water, medical care or facilities.

Simply stated...it isn't likely but easily possible that FEMA could almost literally take over in this country if we had a 'national distaster'  and one sufficient to lead some president to establish martial law and the military went along.

Back to the topic:

Q: What contact, if any, have you had with AOL about your account since July 11? Have they given you any indication that they intend to comply with the subpoena?

A: AOL only contacted us after receiving the subpoena. AOL gave us a limited amount of time to respond and we are currently seeking legal counsel. Further, we are consulting with the Justice Department to see if there is a possible "color of law" violation being committed by Director Godwin.

Paul A. Levy, a lawyer for the Washington-based Public Citizen Litigation Group founded by Ralph Nader, said he has been in contact with the city's lawyer, David L. Bearman, seeking the city's and Godwin's legal explanation for the request.
