I just read that on another fet site.  It's funny,  but they didn't bust Pandora's Box, which is the club we are modeling our club after.  Sends a chill down my spine, but some part of me is kinda interested in the battle this could produce in Rochester.  I am willing to get on TV and speak my side of the issue...and perhaps charming (and "normal") enough to win some to my side.  I think I am tired of living in the shadows...

I wish all the best vibes and energy that your endeavor will be an fantastic experience and rockin journey!

Please keep us all posted, I'm already making my list of customers I have in the Rochester area so I can make a business trip and have the expenses paid for...my evenings would of course be free for me to check out all the wonders Rochester has to offer! ;)

First, before I toss out what might seem negative - congrat's and best wishes!

As has been mentioned, it is important to know your zoning laws, but just as important to also attend your town/city meetings to keep abreast of any potential changes proposed to existing zoning laws.  It is not unheard of for zoning laws to be changed or modified for the express purpose of removing the 'undesirable' elements from a community.  Obviously I don't personally consider what you doing to fall under the umbrella of 'undesirable' since I'm here posting; but take it from a voice of experiece, there may be those who will.

PS - sorry for the doom and gloom.  I went in on a space with some partners a year ago, it didn't go well with a couple of them, and I'm all pissy and bitter.

Having your own facility is fantastic and wonderful and I wish you all the best.  ; )

Are you in an area zoned for adult businesses? You aren't close to any kind of school? Is this a commercial zoning or are there any kinds of limitations on how many employees you may have. Parking, noise, garbage. Your neighbors don't want condoms on their lawns, nor loud drunks at 3:00AM.

Health department rules. How do you propose to sanitize equipment to prevent disease transmission. Just because penetrative sex may not be occurring, people's intimate juices will be on the equipment.

Insurance.

If you're totally legal in every possible way, then set up an appointment with the head of the local police station and be open and upfront about what you're doing. Give them a tour and show them your safety rules, etc. You don't want them overreacting if an upset citizen tries to get you closed down.

I wish you the best and hope you have a really good lawyer. The only thing I can tell you is to retain a really good lawyer that knows the business.

I seem to recall that the private thespian club/society approach with the “theatrical reenactment” clause in the membership contract overcame the adult/sex club issues.  This was in a no-sex-allowed public dungeon. 

On a side note, I had to lease it for private parties and they closed it to public in order to allow sexual contact for my BDSM group.  I didn’t mind extra visitors at our parties so “walk ins” were officially invited to join the “private party” to keep things legal.  The owner felt indemnified by leasing the facility to my corporation.  I do not know if he was truly legally outside of liable exposure but like I said, he *felt* indemnified.

The SCA is a not for profit organization that very strictly controls every activity that takes place in any form that could even be remotely connected with its name or even with its members going off on their own and doing things that look like they could be connected with the SCA.  

And nothing about joining the SCA, or LORT or any other organization will exempt anyone from zoning ordinances, or any other regulations.  People have tried calling their activities a church, psychotherapeautic roleplay, 'acting lessons' and everything else, if the authorities and courts decide that you have violated a law, none of those comic book measures will amount to a hill of beans.


Rather than looking for a 'clever' dodge around the laws, I would suggest following the advice already given to research the laws and moral climate where you are, and make sure that your activities stay well within the lines.

Good Luck Talldarkandwitty. You may have to have a diverse schedule. Such as swinger nights, gay-lesbian nights, and burlesque type shows to draw others in. It is a business. You would probaly not get a BDSM crowd 7 nights a week.
