The Eleventh Circuit Court of Appeals (Federal) last week upheld an Alabama state law that prohibits the sale and use of sex toys. "Sex toys" are defined as items that promote or provide sexual stimulation, and/or stimulate sexual organs. The crime is a misdemeanor with a fine and possible 1 year jail term.

Now some background. Very similar laws are in effect in Georgia, Mississipi, and Texas. As the 11th Circuit has jurisdiction over GA, FL and AL, this ruling automatically validates Georgia's similar law- meaning sex toys are now illegal there. This court is highly conservative, consisting of mostly Republican appointees.

So what the legal landscape now? If the Supreme court passes on ruling, or upholds the 11th Circuit and the Alabama law, sex toys will be illegal and not able to be sold in ANY state which chooses to pass such a law. So, folks in Texas with a vibrator will be in violation of the law if the Supreme Court upholds this 11th Circuit ruling, and you wont be able to buy them anymore in Texas.

It's really an important ruling folks, with implications that go far beyond Alabama.



This is not my post. I found it at another site. I thought you all would find it interesting. Was found on bondage.com. I repeat, this is not my post...lol. Just wanting to make sure everyone knew just in case of any issues with someone posting something which they didn't write themselves.

This was mentioned awhile back when someone was arrested for having party in their home for selling sex toys. I will try to find the thread but no promises on this one.

This isn't quite accurate. The ruling makes it illegal to *sell* sex toys in Alabama, not to possess them. You can still order them via the internet/mail or buy them in states where it's legal.

Unless it has to do with interstate commerce, the states have the right to pass laws regulating commercial dealings within their own state. It's up to the local population to vote out the politicians in favour of these restrictions. They're within their rights to create local jurisdictional rules, afaik.

The ruling said that it was up to the people of Alabama to decide, and to change the law if they feel it's inappropriate. It's not the Federal Government's place to decide local issues. While I might not agree with the law, I see no fault in this ruling, personally.

You're welcome, i've been getting a lot of practice at that lately[:D]. I've read almost every post on here since February i think, so i know when something has been posted before.

I live in Mississippi. This year I tried to order some things online from Adam and Eve. The order wouldn't go thru because, as was stated on the website, i live in an area that they can't send a catalog through the mail. This is apparently something new, because i have ordered from them and received catalogs before there was a website. I have not had similar problems with JT's Stockroom. Maybe cause they don't do mass mailing catalogs.

God, I keep hoping in my lifetime we might see the time come when the government would keep out of our bedrooms. Keep their focus on the real issues such as unemployment, homelessness, hate crimes, etc. instead of trying to tell me I can't participate in some sexual activity I agree to as an adult of legal consenting age! I want my government to govern us for a better world reputation, not tell me I can't buy a vibrator!

actually the laws when passed make it illigal for anyone to buy anything from any where and have it sent to the area that it is against the law and yes those whom now posess such things are actually breaking the law which says in posession of such as well. So now it goes to say just how many folks in those states currently are now law breakers because of their lifestyle and how many will publicly admit such to those around them and hope that there will not be anyone whom will * snitch on em and have em put in jail for such or pay fines or have their face plastered across the tv or paper as a societal law breaker. This has been a ongoing battle for years in many states here. Its just felt harshly right now because lifestylers dident think that their rights could be so easily taken back away from the place where Our freedoms sit today but just look at whats being tempted to be taken away in freedom in Womans rights to their Own bodys and Gays rights in their equallity to their pursute of happiness afforded them as everyone in the USA.
Do you really think that the powers that be in place right now would bat a eye to remove anything they deemed immoral to society or not religiously right in their eyes. Ha boy do you have a rude awakening if you think not. Its easy to talk the talk but not many Lifestylers actually get out there and walk the walk too for Our rights as Lifestylers. No one notices their losses till they are gone and by the time you have loss your rights its way to late to gain em back. If you want
to make comment to Your representitives heres a link to do just that. Ive done the foot work again for you to make a small effort towards applying your rights. So get to writing!!

Well, I'll just have to avoid Alabama.
