DomImus -> Another win for the 2nd Amendment (4/21/2009 4:08:01 PM)

http://ca.news.finance.yahoo.com/s/20042009/34/biz-f-business-wire-ninth-circuit-rules-2nd-amendment-incorporated-states.html

Technically they ruled against petitioners who wanted to run a gun show on country property, but in so doing the panel unanimously agreed that the 2nd Amendment is  binding on the states and local governments which is a very big deal.

Well if this is viewed as a victory for the 2nd amendment.....who do you see as the losers.....America's citizens w/o body armour perhaps?

People who believe in denying Americans their second amendment right are the losers.

Of the inalienable rights enumerated in the Declaration of Independence....life came first .What was it 52 of those citizens over the span of 32 days, lost that inalienable right.High price the rest of us are paying for your second amendment.

Crime extracts a high price on society as well - should we scrap the fourth amendment as well?

So you do beleive in throwing the baby out with the bath water.....
Or perhaps we could keep the conversation in the realm of reality ....and actually discuss the 2nd and its worth...and its cost.

The reality is this:  if it is okay to scrap one of the Bill of Rights, then on what basis can you argue that it isn't okay to scrap any of the others?

As for the value of the Second Amendment, it is this: anyone threatens my life or the life of anyone I hold dear, they are going to get a twelve guage slug in their ass (that is, if they wise up in a hurry).

From your link:

The majority opinion was written by Judge Diarmuid F. O'Scannlain, with a concurring opinion from Judge Ronald M. Gould, who wrote, “The right to bear arms is a bulwark against external invasion…That we have a lawfully armed populace adds a measure of security for all of us and makes it less likely that a band of terrorists could make headway in an attack on any community before more professional forces arrived.”

I can only say thank God for these wise judges.

I myself sleep every night with a loaded shotgun at my side.

Just in case a band of terrorists decides to invade my home.

Who said anything about scrapping...tweaking it a bit to reflect a new reality....now that works for me.

And if I decide that the First Amendment needs to be tweaked a little because I don't like what some people are saying?

Rights are not about society.  They are about individuals.

And these rights are subject to change and interpretation.

Newsflash for you subrob...tweaking is how we came to have the right to be Mirandised.Shoots that post to hell... heh?

If that is true then there is no such things as rights.

Don't be a dumbass on purpose.

One person's rights stop where another persons begins.

I can't shoot anybody for any reason I want to but I still have the right to keep and bear arms.  The fact that some people may abuse that right is no justification for abridging mine.

Miranda expanded rights, it did not restrict them.

It was still the result of an interpatation...tweaking if you will. To read subrobs post..it was part and parcel of the Framers original text.

This isn't to anyone in particular, just to the "usual suspects" in general...

The 2nd Amendment guarantees US citizens the right and the means to protect themselves against acts of violence. That some people elect not to exercise that right is a matter of personal choice, which I respect. However, when some of those who have elected to forego the exercise of that right end up dead as a consequence of their choice, the lesson to be learned is not that we'd all be safer if everybody was unprepared (or unable) to defend themselves.
