The Supreme Court yesterday restricted how far employers may go in considering race in hiring and promotion decisions, a ruling that puts workplaces across the nation on notice that efforts to combat potential discrimination against one group can amount to actual discrimination against another.

The court ruled for white firefighters in New Haven, Conn., who said city officials violated their rights when it threw out the results of a promotions test on which few minorities scored well. The case drew outsize attention because President Obama's nominee for the high court, Judge Sonia Sotomayor, had been part of a unanimous panel on the U.S. Court of Appeals for the 2nd Circuit that endorsed a lower-court ruling upholding New Haven's decision.

The case was a victory for conservative groups and the firefighters, who said the city's resolution had amounted to denying promotions based on skin color. The court's conservatives prevailed in a decision that said employers needed a "strong basis in evidence" that a test is deficient before discarding the results, rather than just "raw racial statistics" that may indicate a subtle discrimination.

"No individual should face workplace discrimination based on race," Justice Anthony M. Kennedy wrote for the five-member majority.

A big reason I don't answer when asked my race on job applications or tests.  Frankly I don't think anyone should answer that question.

Glad they overturned that decision. No one who does what it takes to qualify for a promotion should be denied because they are not from the right group.

Except it wasn't just her. She was on a panel of three judges who made that decision. And the "overturning" of it was essentially to allow new conditions to be added to the finding (the possibility of legal action if they were to change the test conditions.) Already there is additional litigation being filed for the possible reverse discrimination impact of the law's reversal.

So naturally, the psychotic arm of the GOP is claiming that the "squeek by" decision of 5 to 4 (entirely along partisan lines) is REALLY a 9 to 0 decision, and that it PROVES that she's a bad judge, that the SCOTUS has DECLARED her to be a racist.. blah, blah, blah...

Too bad none of it is going to matter in the fucking least. Like it or not republicans, she's heading to the bench. You're just going to have to suck up to the fact that the person who shares YOUR conservative values... is a hispanic woman. Yeah, that's right. She's a conservative in most respects. This whole bullshit teardown of her is for show only. Most of the republicans (who actually count in their fascist little world) are ejaculating in their pants over the prospect of having her there. Why aren't the Josef Goebbles of AM radio telling you that? Because it's all a political show, concoted for your (the GOP sheeple''s) benefit. This resistence is so that they'll have ammo for the mid-terms... "Obama pushed a racist judge onto us all. How do you feel about THAT, whitey? How DARE Obama nominate someone who could prove America's promise of melting pot values! Tell Obama who's still boss! Show America and the world that the Supreme Court is no place for racial equality! Keep it pure, for old white men who are millionaires! Vote republican (name of candidate of your choice)!"

I think that brings it to all of 4 times total she and all of the other judges that voted with her...have been overturned. That's what I have read. I also had hoped though, the decision would be at least 6-3 or more. (Sotomayor actually followed Conn. law but would not have changed this outcome if she had been on the court and didn't recuse)

This is an overdue ruling that overturns Conn. law and now does in fact put all states on notice.

Hopefully this will end discrimination in the workplace for all Americans. The most qualified should be those getting promotions. Work hard and study, advance in your career the right way..

Whenever I encounter that question I always check off “other” and then write in Human. It is the only scientifically accurate answer.

Guinsberg said this would not stand, she figures her ilk will have Barry appoint another few judges down the line.

Whites have a bullseye on their backs but they are so busy dozing in front of the TELSCREEN they don't know what Big Brother is up to, well let's say that USED to be true.

Preferential treatment for minorities stops working as soon as whites become the minority.
