Status: offline 		Coupons are wonderful, but they never have coupons for the things Daddy and I want to buy, except rarely they'll have 50 cents off of 10 yogurts, and t hat's nice but you're honestly not saving THAT much. unless there's a ton of coupons for the foods you want to buy and in our case there isn't.

The bankruptcy laws got a LOT more complicated in 2005.  It's to the point now that it's very rare for a judge to allow someone to represent themselves in a bankruptcy filing.  There's just to many aspects you have to look at.  If nothing else, just look at qualifying based on income.  Three different ways and if you don't qualify based on the means test, the other 2 are very hard to understand.

What's more, a creditor attorney sees a person representing themselves as easy pickings and they will get far more aggressive because they know you don't have the knowledge level.

As long as you are getting good value for your money, this sounds completely reasonable. It mirrors what I spend on my portion of our food bill (I buy my groceries separately these days, to get an accurate picture of my expenses prior to my move). However, for that $200 a month, I get organic produce, local raw milk, and locally pastured meat and poultry, so my expenditures are a lot higher than other members of our household who eat a more processed, subsidized diet. (My calorie breakdown per day is ~42g fat, ~116 g carbs, and ~116 g protein, with a total caloric consumption of ~1400 calories per day).

Status: offline 		It cost $5.99 for a lb of butter out here. It cost $10.00 or more for 1 pkg. of chicken breasts.

Btw when i buy grapes i wash them, dry them and put them in a container in the freezer. They fill you up fast and taste just fine..

I cut waaaay back on my spending.  I used to spend $400/month, now I spend $200/month, and I don't feel like I'm missing anything.  I cut back my cable, my cell phone, my "going out" spending.  I cut everything I reasonably could, which saved me about $500/month.

I don't know if I even want to go to the free consult.

5 years?   My god.   5 whole years!!

5 years is plenty of time to make mistakes and mess up the plan.   As there is always something that comes up.

I don't want my hands tied for that long.

Unless you are able to pay everything off earlier (not likely with a home in the plan), it will go close to 5 years.  Most plans end a little earlier as not all of your creditors will file a claim in time.   If they don't file a claim, they don't get paid and the debt gets discharged.

If things change (like you need to replace your vehicle or you loose income), you contact your attorney's office and they file to modify the plan so you can replace your vehicle.

If the plan becomes unworkable, you can always file for a plan modification or convert it to a chapter 7.

The one thing you can't do is get credit while in the plan.  If you get credit and the trustee finds out, the case will be dimissed and all the debt will come back on you.

At the completion of the plan, you will be current on your home and that will most likely be the only debt you have remaining.  (Unless there are student loans, taxes, etc. that weren't paid off through the plan.)

I would think some money is better then the possibility of.

So suppose they slap a lien on the house- can they force me to sell it?

The lien would have to be settled upon a sale- or by then I can chapter 7 then.

So why would I fix the place up and pay it off if it can be sold out from under me.

Say they find my bank account.  Ok- easy- I switch it all to money orders.
I do not have direct deposit.

If an account gets taken- then I simply open another so as to be able to cash checks.

an unsecured  credit card- is not backed by my house.   So they can not foreclose as I am current on the mortgage.  But if they CAN  force me out of my house- I aint going to fix it up and pay it off.

Is it a civil suit judgement or a criminal restitution judgement?   If it's civil, they can file a claim an get partial payment just like all the other unsecured creditors.  If they don't file, they get nothing and the debt is discharged by order of the court.

If it's a criminal restitution judgement, it's a non-dischargable debt and must be fully paid.

The next question is have they registered the judgement with the registrar of deeds?  If they have, it becomes a lien against your home.  It can still be disharged, but getting the judgement lien removed will cost you an extra $1000 or so in attorney fees.  Or you can stay in the home for 10 years and the judgement lien will automatically be removed.  (At least that's how it works in Tennessee.)

They can when you're not in a bankruptcy, but they won't.  If they move to foreclose, they have to pay all the foreclosure costs up front.  The first mortgage will get paid the proceeds from the auction and they will get whatever is left over to pay their lien.

Unless you've got a lot of equity in that house, they'll be paying a few thousand to foreclose and get nothing in return.  (This is why it's extremely rare for a second mortgage lender to foreclose.)

They can't sieze the home once you file bankruptcy.   If they do decide to start foreclosure proceedings before you file, your attorney can file before the auction date and stop it.  Just be sure to contact your attorney immediately if you get a notice of "We're foreclosing" (not a threat that we could forclose).  Also, do not fail to pick up any certified letters that are sent to you.  Letting them sit at the post office does you no good.

Several details here.  They can clean out you bank account pretty easily if they have a judgement.  You might want to go cash only immediately to avoid that until you have filed.  Also note that the bank charges a $100 fee for having a siezure levied on the account.  Thus, you incur another debt in addition to having the account cleaned out.

If the bank account is with the same people who have the judgement close it immediately.  In most circumstances, they can sieze that account even after a bankruptcy filing.

If they file a judgement lien, it becomes a secured debt.  However, bankruptcy can prevent them from forcing you out of the huose if your attorney can come up wth a feasible plan.

As mentioned above though, they're not going to forclose on your home unless you've got some serious equity in it as they will loose out.  A judgement lien basically ties up the home and says you can't sell it until you pay us on this judgement or make the judgement go away with a bankruptcy.

Status: offline 		Hi Mut,  the suit is a civil complaint.  We have not even been to court yet and there is no  court date.

Sooner then 10 years- I hope to be out of here.
But things can change.

I have some equity in the place- but not a whole lot.  Only the mortgage is on the deed.  As no actual judgment exists at this moment.



There is no bank account with the entity suing.    Maybe - I had $5 there but never use it.



They sent a person out that left a note on my door.  So I am thinking the representative- noted the condition of the house and the cars in the driveway.
Thank you for this reply.  I have a better idea of what questions to ask when I see the attorney.

That includes the organic co-op and farmer's markets I go to on a weekly basis for  things like free range chicken and eggs and local beef. I cook organic and gourmet meals, drink bottled water, love a nice bottle of wine, that includes two people and 3 cats, and lunches are made at home daily, so no cost for eating lunch out but still....I can't imagine cooking the way I do and spending less. I am not going to eat frozen processed food or fish sticks anytime soon. God just coffee is 50.00 a month, then cleaning supplies are another 50.00 or so, before you even get to actual grocery provisions.  Things that are good for you generally are more expensive I'm afraid, and so are the higher end cooking ingredients. It's awful I know, but I like what I like. Not only that but the health costs from eating poorly will cost more in the long run.

If you are able to feed 2 adults, one young person, 2 dogs and 1 cat in southern CA, on about $25 a WEEK, you need to write a book, it will be a bestseller.
 
I try to keep up with coupons, and I tend to save a considerable amount when I can use coupons for items, that I would normally buy, especially when they are on sale.
I don't always use coupons as much as I should, but when I do, I try to save enough to fill up my tank or buy a nice bottle of wine {to encourage the clipping of coupons}.

Me and my s/o shop at Trader Joe's almost exclusively. If you have one near you, I highly recommend it. We've found them in NYC, Chicago, and all over California.

We don't eat much meat, which really helps keep the grocery bills low. We also try to buy things from WalMart when possible and personally/physically healthy: Turkey Spam, Light Velveeta, Organic Applesauce, and organic breakfast bars are a few of the things we buy at WallyWorld.

Having said all that, we spend about $100usd per week (total for the two of us).

I cook and cook well. All I can say is that groceries and other misc supplies must be A LOT more expensive where you live versus Iowa. I spend approx $80 a year on my coffee and it is bloody hell expensive shit and I have to have it shipped in.

Typically what happens is that coupons come out a week before or after an item goes on sale. So your best bet is to hang onto them for a week or two. Scour the ads and then take the coupons with you for the items that are on sale. I've done it that way and I've been able to save 50% of what I spend (basically a 100 dollars of groceries for 50 bucks). Well that and coupled with a store that does double coupons up to a $1.00.




Lately I've been eating much more healthy and so for about two weeks of groceries I spend about 100 dollars. I consume a lot of fresh fruits and vegetables. Additional to that I prefer more organic meats (those without antibiotics and such) it does lead to a more expensive grocery bill, but ultimately I haven't yet gotten sick with the flu like everyone else around me and I feel better. I like free range eggs, and cheese from the local co-op. Which generally run about 2 dollars more at than regular eggs at walmart or meijers.

Today tho- I scored a large pack of red onions... $1.49.   Aldis.   People want a nice wrapper- but if I buy the ones put in a clear plastic bag- it weighs almost double.
