Taser Ruling: Cops Can’t Tase You For Disobeying Orders or Acting Erratically Source: San Fransico Chronicle Police need reasons to believe a suspect is dangerous before firing a Taser and can’t use their stun gun simply because the person is disobeying orders or acting erratically, a federal appeals court in San Francisco ruled Monday. The decision by the Ninth U.S. Circuit Court of Appeals sets judicial standards for police and for people who claim they were victims of excessive force after police hit them with a Taser dar/snip


One would think this to be the case.   hmmm.   We have the taser locally.  To my knowledge it has not be used inappropriately on the local level.

The ruling seems reasonable.  Tasers were considered to be a relatively nonviolent alternative to shooting suspects when they were introduced.  It's clear in the case in question that the cop used a taser in a situation where nobody would consider using a gun.

the one thing is that court tends to be very liberal. So we shall see if it carries over.

I can't blame the officer for thinking the guy was mentally disturbed. Damned near naked, shouting and hitting himself? Yeah, that doesn't make you think he can obey orders and answer questions sanely. But since he'd already called in for backup he could have waited for them.

Sure, the officer could think the man had mental problems based on the suspect's actions but tasing an unarmed man who was standing 15-25 feet away simply because the suspect allegedly took one step toward him seems indefensible to me. And considering that it was determined that the suspect was facing away from the police officer, it seems even worse, in my opinion.

We have a large number of retarded locally.   Most of them wont hurt anyone.  ...are not dangerous.
