Mercnbeth -> Proof there is no need for 'Tort Reform'... (3/11/2010 3:02:26 PM)

The litigation lottery is one of the few growing industries in this economy.

These are actual court cases from last month. There is a 'Most Ridiculous Lawsuit of the Month Poll' site where you can get more details and vote for your favorite.

  • Man sues post office after pigeons he mailed from California to Texas died en route

  • Sandwich shop patrons sue, claiming ads for double meat sandwiches are misleading since there’s no single portion version

  • Man sues police for opening medicine bag, which he says destroyed its magical powers, during his drunk driving arrest

  • Man denied double test time on the LSAT sues, despite failing to demonstrate his claimed ADHD is a limiting disability

  • Former stripper sues club for $1.2 million after efforts to stop her from driving home drunk failed

Something 'bad' had to happen to you today. An ingrown toenail caused by defective socks? Somebody didn't hold the elevator door for you (bonus points if the person was of a different gender or race than you)? Your child got a 'c'? You kid's coach only let him play 4 minutes 52 seconds versus the mandatory recreational basketball league minimum 5 full minutes?

What the hell - get out your phone book, or go on-line and start contacting attorneys; I'm sure you'll find one to extort money from some deep pocket source; beats working for a living.

What I never see attached to stories like this is the outcome. Where's the rest of the story?

So a guy sued the post office over dead pigeons. What really happened? Did the post office promise to deliver overnight, misplace the package for a month, then refuse to pay an insurance claim because the package was eventually delivered? What was the guy asking for - cash value of the pigeons? There's nothing here which says that the lawsuit is ridiculous, or that the tort system is broken.

Truly ridiculous lawsuits are summarily dismissed. People who file a number of ridiculous or bad-faith lawsuits can be designated "vexatious litigators" and have their rights to file lawsuits limited. You can countersue to recover losses.

This just highlights the dangers of using the wrong sized envelope to post pigeons.

I think it was the stamping that did it.[:D]
Otherwise
you are reaping what you sowed..yep reform is needed. but not as much as health coverage for every citizen.

Last night one of the posters here on CM was mean to me. They told me I was wrong about something! I was devestated! I spent the night in my dark closet rocking back and forth while eating truffles. As soon as I can pull myself together I'm going to get a lawyer and sue them for infliction of emotional damage.

I voted for the pigeons. Everyone knows they are unreliable and will loaf off at vacation spots along the way.
