Interesting read:  scary situation where we can agree on the terms of our relationship and then revoke those terms via use of the court.  Case should have never been accepted by the court on the merit that they had an 8 year relationship involving this behavior......IMHO  She sounds like a bit of a drama queen who may well have just mucked up his life forever.  I doubt she lovingly thought through the totality of the ramifications for the father of her child and the resulting effects there.

I can't say for Canada, but in the U.S it would be considered rape. My 2nd wife told me that I could take her while sleeping. It was a fetish of hers.

i think in Washington state it would, indeed, be called rape. It's too chancey doing someone while they're asleep....or being done. i wouldn't want to go there.

I use to be woken up by my man on me all of the time.. if it was his wish I was willing.. if thats the relationship that they had then it should be thrown out.. We can only hope theres somebody with some BDSM experience on the jurry.

WOW....before I was "kinky" I did a couple of my old G/F's while they slept. Give them a little rub on the backside the ass would go up (I thought that WAS consent) and I would go in. No hassle...

When I was married I had a real problem with insomnia, and would do this to her all the time, we called it "going for a midnight stroll"... She never said don't do that.....

I think that should just be thrown out.....sounds sort of like "I changed my mind, you are a lousy fuck, so now it's rape"

Hmmm....seems to me that legally it would set it bad precedent to say that unconscious people can have agreed to a sexual act.  I think that unfortunatly, the number of people who are actually assaulted even though the accused claims it was consensual probably far outweighs those who falsely accuse assault.  Thus, I think we have to air on the side of caution when it comes to the justice system.  However, I think we as citizens need to be cautious as well and accept the risk of our behavior.  Perhaps engaging in the type of play that walks that line of consent should be reserved for people who we trust not to run off crazy and file charges the next time we fight and perhaps we should think twice about involving the justice system in our domestic squabbles.  I say shame on him for engaging in such risky behavior with someone who is not stable and shame on her for not thinking twice about the ways she is affecting other people in her selfish attempt to get back on him.

There's a big difference between having sex while sleeping, and having sex with someone you've just knocked unconscious. Did you guys read the article? Anyway, if she did consent, she shouldn't have pressed charges, but I agree with charlotteS that making it legal to have sex with someone who is out cold and incapable of communicating if they are having breathing or other difficulties is unwise. I also share her concern that people could claim that the person consented, when they did not.

I bang'em all when they are sleeping. It has been previously agreed upon.

If it has not been previously agreed upon or someone has been rendered into such a state that they are incapable of giving consent then you probably deserve to be prosecuted.

Pretty difficult shit....I love the community.

My wife loves it when I wake her in such a pleasant manner. Our standing agreement allows that I have access to her body at all times. If I choked her to unconsciousness, then wake her in such a way, she would be even more thrilled.
So, prior consent... does it stand or not? If you fall asleep (or lose consciousness) is that  like hitting some kind of consent-reset button? This scares me...

I see this as another case of consent to an illegal act being invalid. Doesn't matter who "consented" to what. If it's illegal to have sex with an unconscious person, then that's that. Doesn't matter what they agreed to, because neither one of them have the authority to trump the law.

If you do shit like this, you have to be aware that you're taking a risk that your partner might have a change of heart, or worse yet, that you might accidentally kill the person as the result of the choking etc. If you're not willing to risk the possible consequences of the act, then don't fucking do it. Pure. Simple.
