Alright, if a painting is within the area of public domain, and hence faithful 2D reproductions of it are similarly within the public domain, am I allowed to use such a reproduction as my profile picture? Even were it not of proper age to be in the public domain, an argument could be made for fair use.

That being said, legal right to use it and ability to use it within site rules are two entirely different things. I see a prohibition against “commercial photos or artwork” but that’s a bit vague in my estimation. Does that mean 'commercial photographs and commercial artwork' or simply 'commercial photographs and artwork generally?' Can someone iron that out for me?

By the same token, what are the rules on avatars? Are they governed by the same rules?

All I know is that where I worked long ago a salesman came in selling these pretty cool looking "metallic" pictures. I asked if he had one of the skyline of Cleveland. Hr said "no", can't do it because apparently it is copyrighted. I of course said "You gotta be kidding me" but he insisted that it was illegal. (without paying royalties I would assume)

I wouldn't count on anything being in public domain anymore, apparently someone bought it all. My question is - I am part of the public, where's my cut ? They used my tax dollars (kinda) to pay the architects and builders, but I can't have a picture of it ? 

Of course maybe he was full of it.

Just go ahead and use it.  If there IS an ownership issue and the owner contacts you, it will be a request for you to stop using it, and then you stop using it.  Simple.

You are not seeking to make money from its use, so they cannot claim damages.

The text above the upload button says to use only photos you took yourself. So I'm guessing no, on a profile.

Instead of asking other users about what the site rules are, why don't you ask someone on the site who can answer your question - click the SUPPORT button on the other side, down at the bottom of the page.

Fair enough. I rather assumed someone official would happen along, as this didn't seem like the kind of thing "support" functions are traditionally used for, but I'll send them a message right now.
