First of all let's see them enforce it. First of all construction companies usually go out of business up here every about five years like clockwork. They open up under a new name and they have no legal standing under the old name because they changed names specifically to avoid getting sued for building quarter million dollar egg cartons.

But of course people are that stupid as to not examine the deed. And most get a mortgage so they never see the deed, and the bank doesn't give a fuck. Yes, it is so good here, justice for all. My fucking ass.

I wonder if they still have the covenants, remember when deeds had stipulations that the house can never be sold to Blacks, shit like that ? The courts took care of that, but really, they might not take care of this.

But then, a deed is not a contract in the sense of a normal contract. In a way it is a contract with the government that you are holder in good conduct and due course. But the government did not write that contract specifically, with that provision. What's more the buyer did not sign it.

So this is just another reason why I am looking for a new planet.

T^T

36 states now have banned this.  That leaves 14 that allow it.
