I wonder how far they will take it, and if it will open up doors for future suits.

If this case fails, then those doors will be much harder to open up. Will be an interesting case to follow.

Note that this suit has nothing to do with Rummy approving torture.  This suit claims that a US citizen was ordered imprisoned by the military for no apparent reason.

The Obama administration has argued that the military, and Rumsfeld as its previous head, has unlimited wartime power to do damn near anything with captives.  The only way that this suit has any merit whatsoever is that the plaintiff is a US citizen. 

The case will request that the military provide justification for holding him, and the military will refuse.  After that, anyone's guess.

The judge says it can go forward that means discovery using subpoena. Therefore if the DoD refuses to answer questions and provide documents they can be held in contempt of court.

Did you think the Obama would do anything less? This country has a history of protecting the legacies of past presidents and administration officials as much as possible. Plus, Obama would like nothing more than to sweep the illegal actions of the Bush WH under the rug--the ones he is not continuing that is. I don't see this case going anywhere. This decision will be appealed and eventually the Supremes will decide Rummy was in his right to hold a US citizen incommunicado.
