Oakland police could face federal takeover

SAN FRANCISCO (AP) - Mayor Jean Quan vowed Wednesday to quickly reform the scandal-plagued Oakland Police Department after a frustrated judge threatened a federal takeover if it fails to quickly make good on changes agreed to nine years ago.

U.S. District Judge Thelton Henderson said he "remains in disbelief" that the department has failed to adopt the reforms.

Henderson's frustration with the pace of improvements was evident throughout a scathing five-page ruling issued Tuesday.

"This department finds itself woefully behind its peers around the state and nation," he wrote.

In his ruling, Henderson increased the oversight authority of a court-appointed monitor. Oakland Police Chief Howard Jordan must now consult with the monitor before making important department decisions such as promoting and disciplining officers and changing policing policy and tactics

If you recall, 9 years ago the Oakland PD settled a lawsuit, including changes the PD had to make.

The judge appointed a monitor in 2003 to ensure the city complied with terms of a $10.5 million settlement of a lawsuit filed by victims of a notorious group of police officers known as "The Riders."

The group was accused of beating and framing suspects in the West Oakland area for years. One officer was acquitted at trial and criminal charges against two former officers were dismissed after two trials ended in hung juries. A fourth former officer remains a fugitive who disappeared after charged were filed in 2000.

The current monitor, Robert Warshaw, was appointed in 2010 and oversees the settlement with a staff of seven people.

The settlement included 51 specific reforms the department agreed to make within five years. Henderson noted Tuesday that he's extended the compliance deadline by years to little effect.

"Defendants have achieved full compliance with just over half of those tasks and, worse yet, have fallen in and out of compliance on some tasks, thus indicating a lack of sustainability," Henderson wrote. "The outstanding tasks are not minor formalities; instead, they are significant areas that go to the heart of any police department, including how internal affairs investigations are completed, how officers are supervised, and the use and reporting of force."


So, before anyone jumps to the defense of the PD, make sure your position is accurate.

I always breath a sigh of relief when a police department can be in shit this deep and still be cited for testimonials by the local rightwing media ,,, I better start sending primary canvassers to Oakland before the Disney wears off!

Damn would you not shit if I showed up...lol... your backyard is a lot warmer than mine. Hell as long as we had the proper permits... fire extinguishers... fire pit that passes local laws…and the fire service does not have a no burn order we could burn all the flags you want.

I don't follow your posts much, Heretic, but what little I've read has given me the impression you're a sensible guy.  I think in this particular case you shot from the hip first and (didn't) ask questions later.  I'm confident some property crimes were committed by Occupiers last night.  I'm also confident some assaults were committed by police officers last night.

One example of how ridiculous this situation is: a medic was arrested last night and charged with failure to disperse from a riot scene, and bail was set at $5,000.  Seriously.

Right now, people all over the world are donating to bail funds.  The world is watching, and the Oakland PD (and the United States) isn't looking good.  I am not trying to slam all officers everywhere, and, for example, I never use the word "pig," but the Oakland PD is like a man with multiple restraining orders against him trying to tell you that that woman he just gave a black eye hit him first.  Sooner or later, the institution loses credibility.

Occupy Toronto has called a solidarity action with Occupy Oakland for tonight in front of the US Consulate in Toronto, 7:00 pm to 10:00 pm.
Obviously IM not there, but I am in solidarity..Our own cops have a lot to answer for, not just OWS but the G20 G8 summits

Timmy is the Man!
of all the streamers that have been covering this stuff, he's gonna be the guy who they get the really historic footage from.
He rarely if ever colors the moment being captured.

Oh there isn't a doubt in my mind that the cops played rough, RedMagic. Oakland has a reputation to live up to, after all.

It doesn't change fact that the protesters became a vandalizing mob, and once again, exercised a form of free speech that is guaranteed to further marginalize the movement, rather than drawing in the mainstream they claim to represent.

Of course, what is especially fun to watch in these conversations are the efforts to still draw in the Occupist efforts as an asset to the Democrat party, while hoping like hell nobody points out that Oakland is a Democrat controlled city.
