She already got her refund. That's what pissed off Scalia so much. That they were 'deciding' a case which didn't have any extant controversy, and therefore there wasn't any reason to even take it up at that point.

Well, thing is, now that Scalia is on record as "We didn't have jurisdiction!", he's going to have a hard time with the Prop 8 decision...

It is the proper ruling but I must admit farglebargle I was looking forward to your big government and corrupted Supreme Court ramble if they had upheld it... But my entertainment can wait...There are other rulings coming down soon.

Scalia's corrupt supreme court rant cannot be surpassed, so why bother trying?

I recall back in 1996 when this was first pushed into law by the Republican Congress. I knew the law was unconstitutional back then. And the amount of money used to push it not only into law, but defending it from those who made good arguments that it be removed. As years went by, more and more court challenges took place, and conservatives/Republicans and even the newly formed Tea Party threw dollar after dollar into 'shoring up the defenses'. Not once did any of these groups care about the divorce rate for straight couples.

So when I hear conservatives bitch about 'wasting money' by liberals and Democrats, I had to laugh knowing how ironic their 'viewpoint' was. How much money was poured into defending this lame law since it was approved? I have no idea. But today, it is now considered 'wasted money'. Now where are all those 'fiscal conservatives' who are so quick to bitch about money wasted? Do not hear a peep in the population nor on this board!

This is a very good day to be gay for many gay people!

The great thing is while this ruling only strikes section 3 which means the federal government must recognize all legal marriages it also laid the ground work for a challenge of section 2 which lets states without same sex marriage not recognize those marriages performed elsewhere.

The prop 8 standings stuff was the weaseling I've come to expect from Roberts I'm just disappointed that 3 of the liberal justices joined him. Kennedy wrote the DOMA opinion and I cannot see how he could find DOMA to be a 5th and 14th violation but not find all same sex marriages bans to be the same.
