Anchor Baby

There is no such thing as an anchor baby, this is a misnomer. Parents cannot weigh anchor in the USA by having a baby here. None of the status vested in the baby transfers to the parents until the baby turns into an adult and reaches the age of 21 years old. At that point the "anchor baby" can submit papers to give its parents permanent residence status.

Only misinformed, bigoted, anti-immigration nut jobs use this term -- and in this thread all you have to do is check the source.

I'll agree that a child can't sponsor the parents until age 21. But, as courts are frequently reluctant to split up families and they have a hell of a time deporting an American citizen a child can effectively 'anchor' a family in the US for a goodly amount of time as the case works its way through the system.

American judges just don't like to split up families.

What you are talking about here is some kind of imaginary fiction. The power to remove illegal aliens is vested with the Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE). In some instances, their powers are subject to review by an immigration judge (IJ.)

Never in my tenure as an immigration lawyer have I seen a deportation stopped b/c the alien had a US citizen child. If an IJ tried to stop a deportation based on this ground, the IJ would be immediately overruled on appeal.

Begging to the DHS or ICE might work on a temporary basis, but the parents are far from being anchored in the USA. ICE and the DHS have no problem splitting families up by knocking on doors and seizing parents out of the home at 5 AM in the morning.

Aliens who cross the border are subject to summary deportation (without any kind of judicial review) and most aliens who are deported from the USA are removed without any kind of legal representation.
