It isn't unlawful to film without condom's, but OSHA says this is an unsafe practice. Those in the industry didn't complain about the safety aspects, but outside forces did.

I think condoms FTW.

Seriously.
The porn industry can cry over it all they want, but get it together, be the example you want to see, and wear stupid condoms.

I realize that is not necessarily the popular opinion.
But like...if I work in construction, I wear a hard hat. If I work in food service, I wear gloves. I just think its the way to go and I'm glad to see OSHA taking it seriously.

Personally I think the fine is wrong. There was no workplace accident. And there are no laws stating the performers have to wear condoms. The porn company does actively test their performers for HIV as well as other STDs. So I really do not seek the porn company being negligent in this case. Had they been negligent then it would be a different story. 

Do I believe they should wear condoms? Yes I do. But I feel a law should be passed first and then if they do not comply to fine them.

Not true, last confirmed case of on set HIV transmission was 2004. I would call that a pretty clean record.

When I lived in South Florida, which has among the highest rates of new AIDS cases in the country, I was appalled at the % of guys who didn't know me all that well who would have had sex without a condom had I not insisted. (My Rhodes Scholar was one notable exception.)

Perhaps they thought I was safe due to the sexy librarian thing I have going on, but more likely it's a case of monkey see, monkey do.

I do not disagree that it is not a threat. The point I was making is that the porn industry did take steps to protect their people and it worked. 2004 was the last was the last confirmed on set transfer of HIV. The other HIV cases testing proved they caught it off set. 10 years is a good safety record.

And as I said, I do think they should wear condoms. I just think the fine was unfair as there was no work related accident. Pass a law or give a warning first saying next time there will be fines. But to come in and fine them without any prior warning or suggestion is really unfair.

I agree with Mummy. I also believe they should be safe, but until the laws are dealt out fairly, one agency coming in to fine someone isn't right. What I find interesting is who started the complaints about what they were doing that brought OSHA in, in the first place.

I am a stickler when it comes to the law, but with this?

The most recent case I heard was just recent. It may not have been work related, but before confirmation through testing that person could have passed it to all work partners by not using condoms. Since they can't order and be sure the workers are using condoms outside of work, the only protection they have in the workplace are condoms.

So regardless of whether the most recent case was infected during work, they were infected. How else can these companies protect their employees from being infected from someone who got infected outside of work?

I do not disagree the porn industry should start using condoms in addition to what they are already doing. They have had a clean record for 10 years now. So they have taken steps to protect their employees and it has worked. But you are right in that they do need to do more.

What I disagree with is the fine from OSHA. If OSHA was really all that concerned about employee health and safety then they would have acted 20 years ago to prevent the porn women from getting pregnant. OSHA never once issue a citation for occupational hazard of women getting pregnant on set. And plenty of the women did get pregnant.

In this particular case there was no work case accident. OSHA abused its power. Its sort of like you breaking your arm at home. Your neighbor calls OSHA and say well he could of broke him arm at work. And then OSHA coming in and fining the company where you work for a "possible" accident.

I do not believe OSHA is qualified to make medical decisions. Change the law then let OSHA enforce it as they should.

You do realize there's a huge difference between pregnancy and a deadly disease, right? Women getting pregnant working in the porn field is a personal responsibility thing. A woman can take precautions that will prevent pregnancy nearly 100%. OSHA can't force women to take birth control.

The company, and the industry in general can fight/appeal the fine, and they probably should. I think, however, if they did a ruling could very likely come down ordering condoms at all times. This would be a good thing.

You can't compare pregnancy with death. A pregnancy can be terminated. There is no cure for HIV/AIDS.

And you do realize that there are many other STD's that can have seriously permanent and debilitating consequences? Syphilis can be particularly nasty showing no outward signs for years all the while damaging the heart, nerves, brain and other major organs leading to blindness, dementia, and even death HIV is not the only STD that can result in death. Yet OSHA saw fit never to site these other STDs as an occupational hazard in the porn industry.

If you are going to say something is an occupational hazard, you need to look at the whole picture and not just HIV. That is an extremely narrow minded view.

I googled "california safety work law" and found section 3383 of the california health and safety on workplace regulation says:

(a) Body protection may be required for employees whose work exposes parts of their body, not otherwise protected as required by other orders in this article, to hazardous or flying substances or objects.

(b) Clothing appropriate for the work being done shall be worn. Loose sleeves, tails, ties, lapels, cuffs, or other loose clothing which can be entangled in moving machinery shall not be worn.

(c) Clothing saturated or impregnated with flammable liquids, corrosive substances, irritants or oxidizing agents shall be removed and shall not be worn until properly cleaned.


It doesn't specificate what's the nature of the hazard, just that if there is any protective clothing shall be worn. To me it seems there is a law.
