Not gonna fly, but not unheard of the RNC to propose Constitutional Amendments. Even the ERA was proposed in 1940. We are still waiting. LOL

Well, we'll see what the demos are proposing and determine which is the more outlandish.

“In Obergefell, five unelected lawyers robbed 320 million Americans of their legitimate constitutional authority to define marriage as the union of one man and one woman.

Where is THAT in the Constitution (?) the "legitimate constitutional authority to define marriage as the union of one man and one woman."

I believe he was referring to Article III, Section 2. Could be wrong.

WickedsDesire -> RE: GOP repeats calls for new constitutional amendments (7/21/2016 6:03:18 AM)

ERA?

I like Clinton's proposal for an amendment much better... The Republicans believe in free choice... then they want to pass amendments that restrict it to THEIR free choice only.

Pretty sure you are wrong.

That is what gives the fed the right to not allow an unconstitutional definition of marriage.

Seeing how it's not IN the Constitution granting the Federal Government the authority, it remains with the People and/or the States.

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.

Sha Pow. Oh yes it is.

It defines where the unelected 5 came from tho. The Constitution is mute on marriage.

mnottertail -> RE: GOP repeats calls for new constitutional amendments (7/21/2016 10:23:28 AM)

it is also mute on murder, running stop signs, lobbyists, corporations..........a host of things.

Hence, it is up to SCOTUS to sort it out for us. We don't have to agree with what they say, Lord knows I don't always, and we can work toward changing it, but until it is changed, it is the law of the land/against the law of the land.

mnottertail -> RE: GOP repeats calls for new constitutional amendments (7/21/2016 11:20:20 AM)

hence 3, 2 and its in the constitution.
