So, Saturday...

M and I went for a ride, I was on the Octane. We met friends for breakfast and then tooled around East County a little bit. On the way home, we stopped at one of my favorite places - an herb/gift/soap/coffee store. This store has a dirt parking lot.

As I'm pulling in, one of the cars starts backing up. I stop about 2 car lengths from him to give him room to back up. I expect him to turn to be able to get out. Nope. He's backing straight up at me. I'm trying to back the bike up, but the dirt parking lot isn't giving me a lot of grip. I'm honking the horn and people are waving their arms and yelling at him. He doesn't stop.

He backs straight into me, knocking me and the bike down.

M had run over and yanked open the guys door (I honestly was a little afraid M was going to rip him out of the car). The asshole immediately blames me for hitting him.

I was lucky that it was a dirt parking lot, the damage was minimal. There's a scuff on the front fender from where he hit me, the rear brake pedal broke off and a scuff on the exhaust.

I have a bruise on my right knee, a bruise on my left wrist (I guess the mirror hit my arm) and muscle spasms in right shoulder. The armor in my jacket protected my shoulder and elbow from bruises.

So, because M and this guy end up in an argument, the asshole calls the police. There is no real damage and it's on private property, so the Sheriff is not amused.

And the first words the asshole says to the Sheriff - "That's a lot of bike. She shouldn't be on it, no woman should be on it. She can't control it. That's why she hit me."

The Sheriff takes statements from 2 of the "spectators", M, me and the asshole. Before he leaves the Sheriff says to me - It's under $500 in damage and it's private property, so I can't write him a ticket. But, I'll give you a copy of the report, in case you decide to take him to court....because I'm pretty sure you have a neck injury."

Wow..

It's not just lack of attention, it's lack of brains!

You don't have a neck injury, do you? He was just saying that as an encouragement to sue the asshole?

First, how are you feeling? Second what was he driving? Being California and the land of underinsured drivers you could be suffering anything from a neck sprain, to whiplash, to permanent nerve damage. ;^)

Then there is karma. Trust that She is a bitch...and she knows where he lives.

Wow, glad it wasn't worse. It took a lot of nerve for him to call the cops, especially when there were witnesses. He must be a bit stupid.

I'm stiff, but it's improving. And yeah....I think he was irritated that he couldn't give the asshole a ticket.

I think it's because he was intimidated by M. M can be intimidating without trying...and he was trying. I think the asshole was hoping that M would hit him, he kept antagonizing him.

I was very thankful that M stayed calm even though he was so angry. He tends to be fiercely protective of me.

Good, it always seems the couple days after is when the pain sets in. Try a soak in a hot bath with a cup of epsom salts, a few drops of lavender essential oil, and some baking soda. It should help that shoulder loosen up.

P.S. I've been MIA for a bit but you look absolutely stunning with your dark hair!

It would be interesting to see this guy's driving/accident record, how many other accidents has he been in, I wonder.. Since he is trying to blame you for the accident, I would say this isn't his first time.. Maybe you should put a go pro camera on your helmet..

There are a lot of idiots driving cars out there.. I have almost been killed twice in the last year and as a pedestrian (mostly), I see just how un-attentive drivers are.. or they just dont give a shite.. there is one street I used to have to cross (at the crosswalk with a school on the corner) and the drivers will not stop at all, and if you are crossing most dont even slow down, they just try to drive around you.. I had thought of starting to video them with my cell phone camera and putting the vids up on a website and/or YouTube but I am not there anymore and doubt I will do any walking where I am right now.. if I was still there I would cuz it was bad..

I think you should sue the guy or have your insurance company sue him/his company.. drivers/people have to learn lessons to make them more careful to prevent future more serious accidents.. the best way is to hit em in their pocketbook..

Or see if the cop who filled out the report can provide his home address and send somebody round to have words with him.
(In this case "words" is a euphemism for "caving his head in with a blunt implement")
Though as everybody else has said already, suing the little prick for whiplash and damage to your wheels would be a better move, albeit less satisfying. Very glad to hear (as the snark above likely hides) that the sorry fuckwit didn't hurt either of you too badly, at least.

Well, the bike is a manufacturers demo and any damage would be handled by the insurance they use on these bikes.

I could still sue for medical.

I do actually have his name and address on the police report because the Sheriff took license information from both of us. I was actually a little heart warmed to see how many people in the motorcycle community offered to go have a "chat" with him on my behalf. [:)]

well,... it happened in an area you like to go to and if he lives in the area or goes there frequently, you might end up.. um.. er.. "running into each other" again? I would put a go pro camera on your helmet just in case.. at the very least you would get some great vids of the scenery..

Years ago I got lightly rear ended at a stop light, no damage done to the car but neck started bothering me (and for years afterward).. I didnt sue or make a claim and it took me a while to figure out that the reason my neck bothered me was from that very minor accident.. Dont take the medical/physical damage to your body lightly.. keep a diary of your pains, how you feel, pain meds you take, time off work, etc so if you decide to sue you have a record of the pain, suffering, etc.. and know what the statute of limitations for that kinda lawsuit is there..

I dislike having a Go Pro on the helmet as it causes more wind buffeting...which is big on our freeways here.

My bike actually has a Go Pro mount on the front fork, but I can't do that on the Octane since it doesn't belong to me.

Now, as for this particular idiot, not that I am advocating anything but....

A tire iron impacting the knee cap when swung like a baseball bat leaves a lasting impression where as if the testicles were impacted, the pain is much shorter.

I'm so glad you're okay.

This is a college town. Every street corner has a crosswalk with signs to yield to pedestrians. What drives me crazy are the kids who can't walk ten feet to the crosswalk where we will see them. Instead they step out from behind trucks with headphones on and blithely jaywalk.

A couple of times I have wanted to get out of the car, shake the idiot child and demands she call her mother and allow me to explain that she's too stupid to cross a street and obviously sending her to college is a waste of money.
