Then, like now, the penalities for killing a person of color were lighter for whites.

Murder = 40 years (Life)

Terrorist = public execution

I think he should be charged and prosecuted for both crimes.

Now... with your stomping example... the first crime is stomping you for your money...but there is a second crime of stomping you because of your skin color... Or do you not believe stomping you for your skin color is a crime? I do. The stomper should be prosecuted for each crime he commits.

Now we both agree that the problem with this law is proving motive and because of this I think the law would be abused so i am against it...But i do believe committing any crime and in the process a motive of racism is used then two crimes are committed not just one... but i don't see a foolproof way to determine motive.

Murder 2 the attacker comes up behind his victim an breaks his leg with a baseball bat. He the systematically starts breaking bones to inflict as much pain as possible before the victim dies.
Since attacker one killed his victim because that person was black do you really think that he should receive a more severe punishment than the 2nd killer since the second person just likes to hurt people.
