I read about this in the morning paper (Chicago Tribune) today. It seems to me that if a religious organization starts an "affiliated business" with 100's (or even 1000's) of employees, administering the wages and benefits (in this case, pensions) for those employees should be subject to existing Federal/state laws, regardless of the employer's religious orientation. If you hire a custodian/handyman to service your church and its grounds, fine. Do whatever. But when you hire 100's of people (of all faiths) to work in a business that the church owns and these employees are not actual members of its religious congregation, then I don't see where an exemption from ERISA should apply.
