Hanging In The Balance Cuffs ready to take fight to Iowa court by Tom Barton Iowa State Daily December 13, 2004 Unsatisfied with the outcome of their extensive appeals within Iowa State's judicial process and holding little hope for a successful appeal before the Board of Regents, Cuffs is preparing to take its battle to the courtroom. The Board of Regents is scheduled to hear the ISU organization's appeal at its meeting Thursday in the Sun Room of the Memorial Union. There is doubt, however, that the regents will even hear the appeal. Some support a memorandum submitted to board members by the board's executive director and its Legal Affairs and Human Resources Department calling for the regents to deny the group's request for an appeal. Board of Regents staff could not comment on the recommendation or the group's case, stating that it is board policy not to comment on student appeals and litigation for reasons of protecting individuals' rights to have their educational records kept confidential, as required under federal law. Some regents have openly expressed their support for the university's decision to prohibit the kinds of demonstrations that were determined to be in violation of Student Disciplinary Regulations and Iowa law. Cuffs, a campus organization with the goal of teaching safe sadism and masochism, was investigated by the Office of Judicial Affairs after a Nov. 10, 2003, meeting during which group president Duane Long flogged a clothed volunteer to demonstrate how to properly and safely perform BDSM. Condon's portrait is replete with warts, but warts we mostly understand. Beyond these faults we see a dedicated entomologist whose quirky fascination with gall wasps eventually metamorphosized into single-minded exploration of human sexuality. We sense a basically decent man who, in order to free himself and others from the shackles of ignorant religiosity, doggedly followed the facts wherever they took him. Various biographical sources tell another story. The real Kinsey was obsessed with sex -- not just scientifically curious about it. Condon's film does show the doctor having a sexual relationship with a young male assistant who later made love to Kinsey's wife, but viewers are led to believe that Kinsey's tryst with his young subordinate was an unexpected novelty. Indeed, the film portrays Kinsey as the passive party who nervously, then passionately, accepts the erotic invitation of his young subordinate -- an implausible role for the imperious professor whose intimacy with male assistants at the institute was nothing unusual. Similarly, the movie shows a disconsolate Kinsey sitting regretfully in his bathroom after an act of self-mutilation. But this belated scene doesn't leave the impression that masochism was, for the institute's founder, a libidinal staple. A segment showing the professor suspended in midair, clutching a rope that extended around an elevated pipe and was tied to his scrotum, would give viewers a more vivid impression of Kinsey's sexual demons. It would also leave them less sanguine about the doctor's scientific credibility. Needless to say, I was hoping for a non-Bush win and swing back towards the center for our national ideology. We who produce sites like mine (and those that are much more sexual/graphic in nature) are right on the forefront of the national debate over free speech and obscenity. By virtue of it's very nature, the current Administration is not my friend. It's not your friend, either, if you -- as a consenting adult -- enjoy visiting Websites such as mine. Granted, I don't think I'm on any government "hit list". After all, I don't have any full-frontal nudity, simulated or real sexual acts, or any of the other "red flags" that will get other sites in trouble. Oh. Wait. This is a site about bondage. So maybe I will raise an eyebrow or two with the powers that be. Despite the fact that this site is my personal, spiritual, emotional exploration via the physical catalyst of rope bondage, under the current tenants of the CDA (Communications Decency Act) if someone in Mississippi or Utah wandered past my disclaimer and warning and found these pages offensive to their "community standards" of decency, I could be prosecuted -- even though I'm based in New York, where the community standards are different. Scary. Fortunately, the National Coalition for Sexual Freedom (NCSF) and Barbara Nitke are fighting for my right to have this Website untouched by censorship. They are currently waiting for a panel of judges to decide their case against the CDA. If they win, then the case goes to the Supreme Court and we have a chance of getting the second pillar of the CDA struck down. That possible ray light notwithstanding, I have a feeling it's going to be a long four years for those of us who desire true freedom of speech and civil rights I encourage you to visit the NCSF site and if you agree with what they're trying to do, send them a donation, no matter how small.
