Yeah, I would count that - but I agree with Mercnbeth that you should trust your partner more than the Dungeon Master/Mistress or the Monitors ... you are the person ultimately responsible for your safety and when you agree to scene with someone, you should trust them to be careful with you .. the first time scening with someone, I can definitely see doing it in a public arena where there are others should something go wrong, but you do still have to trust that person above all else because he/she could do something massive before the DM/Monitors could get to you to stop things.
