I live in Washington state and have professional video equipment.  I closed my business last year because I was tired of shooting wedding videos and getting underpaid for commercial work.

Anyway, my wife and I would like to shoot adult videos, especially those with a BDSM theme (to be sold, not just home movies,) but we're not sure if that's legal in Washington.  (Or Idaho for that matter.)

Has anyone looked into this or have any advice?  Anyone know of a Washington or Idaho licensed attorney knowledgable in this field?

Any help would be appreciated.

p.s.  We do still like making home movies if anyone's interested in going in front of our camera.

Well, you definately need to have a visit with a lawyer who knows adult entertainment laws, because you're going to have a tangle of legal crap to go through from getting consent forms signed by the "actors" to how to deal with royalties to distribution laws and everything in between.   I believe with the way the US laws are set up, if you show BDSM activities, you can't show graphic sex, so you need to research exactly what is legal for you to shoot - and a good lawyer is your best bet.

Don't ask us, ask an attorney.

There are huge portions of the US that creating porn is illegal. If you happen to be in one of those areas and get bad advice. You might end up needing one anyhooo. Don't be a cheapass and get your ass in a jam. Talk to those in the business of knowing the law.

Actually, the bdsm+sex issue isn't a law. There are currently subscription web sites out there that make quality movies with BDSM and graphic sex.

We have made them too and have sold them online...though now I'll have to check and see if it is illegal.   I don't think so, since we do have studios in Jacksonville that make some softcore stuff.  But still, the statutes are online, so time to do a quick scan.

We're starting back in again, with S&M, Bondage, CBT themes.  Too bad we're kitty-corner from one another.  Having someone else work the cameras and angles would be great.

I've read the RCW's (Revised Code of Washington) and my concern is that the law would see this as prostitution.  It says essentially a person cannot profit from sexual acts with others performed by either themselves or others.  Ergo, if I pay someone to have sex or even if I don't pay them but still financially profit by the sale of the video I could be in trouble. 

What I can't find is case law or any exceptions pertaining to video production (paid actors,) only very specific criteria under which you can display said video publicly.  (I could legally show them but may or may not be able to make them.)

I think I figured out why BDSM videos so seldom contain sex.  That's because so long as you don't show those certain sex acts (i.e. genital penetration or certain other sexual stimulation) that it doesn't fall under the laws pertaining to prostitution and sex. 

What I did find in Washington that appears to be legal (again I'd double check with a lawyer before putting it on sale) is that you could pay someone to masturbate on camera since they are not actually doing anything physical with anyone else.

So anyway, anyone know a good lawyer?
