A dear friend of mine here in the local community sent this one to me and it made me think what the future of my state and our community has in store.

My understanding from the article is that it's for people with previous convictions, restraining orders and will help curb permits for weapons.

Domestic violence is not BDSM kink.

Am I missing something here?

This has nothing whatsoever to do with the 'community" and if you think it does, YOU are badly misinformed---go visit a battered women's shelter---you'll soon see, this is a godsend.

While consenual kink and BDSM is sometimes mistaken for domestic violence, I agree. Laws to help prevent domestic violence are good things. People who abuse their partners are simply disgusting to me until they learn to control themselves and become better people. This bill doesn't seem to be targeting BDSMers so I don't think it's going to affect us any more than any other domestic violence law.

Despite the mythology, very few places can bdsm be charged as a violent crime.  If they prosecute pro-dommes for sex crimes as they do in California, that creates a massive amount of case law that bdsm is sex not violence. 

I have no problem with prosecuting (and banging into a wall a few times) abusers to the fullest extent of the law.

I am simply appalled by a state that doesn't have Domestic Violence deemed a crime already!

And as other posters have said--- Domestic Violence certainly isn't BDSM.

I do have a question.  What about states where you cannot consent to battery.  I know that MA and MD both have laws like that, but they don't get enforced very much in the community.  Do people think they could be enforced in that way?

I read this Op, and thought what the heck am I missing here....  this wonderful erotic foreplay or during play has nothing to do with domestic battery..or violence...  at least my understanding..... then I went to post and I am not alone on this confusion of the OP..

I fail to see the down side of this law either. AS for inability to consent to battery, that's not tough to work around cite it as sex as a full contact sport, they don't have a prayer unless they want to outlaw football too, LOL.

Far too many legal loopholes we can use to skirt the law if it is in fact a consentual BDSM event/scene/relationship.

From My perspective, one of the most important things We, as a community, have a responsibility in doing, is emphasizing the difference between consentual and non-consentual activities, that in some cases may look the same to the vanilla world.  We should never turn Our collective backs on those in non-consentual domestic violence situations.  That was done already far too long in this country (USA) and by no means should continue.

Archer's right; the key, though, is to establish there was consent.  Not so much for the loopholes, but for the ridicule the prosecution will undergo, when photos of the 'victim' in full hood, latex, cuffs, whips, and fuzzy dice dangling from their groins..... makes it difficult to prove the witness is a credible one.

In short, learn your communities laws.  If you don't like em, work to change em.  If you can't, either abide by them, make damn sure people can't see you breaking them, or move.
