My understanding is that Williams (sex shop owner, female, how cool is that?) tried to have the law overturned based on the basis that Lawrence v. Texas set a precedent for a Constitutional right to sexual freedom... Which, IMO, would be a given in a perfect world, buttttt.... Since this law involved the state's right to regulate commerce rather than individual behavior, SCOTUS shot down the appeal.
Ostensibly.
i'm certainly not going to argue that the shift in Court demographics didn't have anything to do with it... ("red state"? Come on, this ain't kindergarden, folks... we can think outside of primary colors here)

Interesting that this may have just been an afterthought in a 14 page (!!!!!!!!!!!!!!) law written primarily to shut down strip clubs...

Ya know, what annoys me the most about this kind of bullshit is that dildos and vibrators are great for masturbation, whether solo or mutual.  These kind of tools/toys are great for safer sex and lowering the chance of an unintended pregnancy.
How is that NOT a medical benefit? 

Plus having several orgasms a day boosts your mental and emotional well being!

Because it is a religious thing. To some people, masturbation is as equal a sin as premarital sex. And in Alabama, those religious people are trying to force that belief on the population.

In this case it seems to be the corprate sex shops trying to force thier will on the people of Alabama.  What are dildoes made out of?   Oil....

Also note the OP is not true (liberals always seem to need to make stuff up to have issues to talk about), as has been pointed out, use and possession is 100% legal, just the public sale.  Mail order is fine and 100% legal.  This is one reason I would never want to live in Alabama, but it seems fine to segregate those kinds of folks there

Your quote is the federal circuit court's ruling, I was referring to the US Supreme Court's denial of cert.  Sexual privacy isn't a fundamental right, there's not a constitutional issue for them to hear.  The case has yet to be decided by the highest law in the land, but again they hear cases with extreme facts and this doesn't seem to present those.

theres a sign behind the cash register at the starship i shop at that says...

items sold here may be used as sexual toys only by college students working on a (class project that i cant remember the word for) or when prescribed by a licensed physician only.  otherwise, they are sold as novelties only.

it still cracks me up every time i go in there-lol

its only illegal to sell realistic looking sex toys in texas...so they have stickers on the package that say "sold as novelty items only" and they keep right on selling them....

chelle,  as for "novelty" I am glad they found a way to sell them,  really giving the [religious right] the finger.
