"Max Hardcore" is a pretty funny site in a weird, weird way. I just find the little snippets on his site a riot - for example, "Britni is a cheerleader & potentially a fruitful future mother."  He goes on to add that a gangbang in a "smelly locker room" should straighten her out. Aside from that, the site seems pretty tame by most standards. If Floridians consider him indecent, I'd better cancel my trip to Disney World!

All silliness aside, the guy does NOT deserve to go to prison for 100 years!

There are all kinds of REAL issues to be concerned over with this. Does Tampa have juristiction simply because the web servers were located there. Can you avoid charges of postal fraud by using FedEx instead of the postal system? Does third party libality exist for shiping? Can porn actualy be clasified as 'political' speach?

There is also lots to suggest that an appeal will be succesful. A piece at http://www2.tbo.com/content/2008/jun/06/na-adult-movie-producer-found-guilty-in-obscenity-/ suggests that the jury was wanting to aquit on at least some charges but was instructed not to. If that was the case, then a jurry-tampering mistrial might be in order. In addation, MaxWorld was already take to court before on obscenity charges in 1998 (damn this evil bush dictatorship!) and that resulted in 2 hung jurries.

For me the biggest worry is that proscuters were trying to seize his assets and conficate his house. That more than anythign shows to me that the 'public morals' thing was just a covery story and that what this is realy all about is that someone had money and the government wanted to take it from him.

But no. Forget all that. Just keep on with the single minded focus of 'christians hat sex' and nitpicking over the exact definition of what obscene means. As if that were somehow more important than the REAL threat to our rights.

I find this trial obscene.   I really don't care what is in porn.  I believe it is protected under free speech.  Unfortunately, I think we are going to see more and more of this as we search for ways to ignore real issues.  Think of the gay marriage issue which had a good portion of the nation in a frenzy and kept Bush in the White house.  Sad really to think of how easily manipulated our system is.

Personally, I happen to think Max Hardcore rocks.  One of my favorite clips of his is dubbed in German.  The love making becomes ever so much more poignant accompanied by the gutteral sounds from this exquisite language.

Couldn't their energy be better spent harrassing child abusers? Really, his site isn't that abhorent. And, there's this new web power I discovered a long time ago...

TheHungryTiger, I think the article covers most of the bigger issues in passing. The focus is on obscenity because that's the moral hook that is always used to get cases like this before the eyes of the public. Theoretically speaking, if this kind of story lost its moral hook there'd be no way to get a conviction - everyone would just shrug and say "free speech, move along, nothing to see here..."

Moral standards and obscenity are the main justifications behind this kind of prosecution. I agree with you about everything else you stated.

My point is that the 'moral hook' works in the oposite direction also. The alt-sex comunity can get just as caught up in a blind panic as anyone else. Whenever the word 'porn' and 'internet' are both mentioned in the same setence, kinksters seem to loose all sense of logic. Instead just reciting the same old panic atacks abotu how we are living in the most opresive police state ever.

Moral panic does happen. There are people that exist that will change any news item into rants about how deviant sex is a danger to society. But there are also people that exist that will change any news item into rants about how the evil christians will destroy us all.

This is so ridiculous and should not even be brought to court causing a waste of time and money!  I would think the prosecutors in Tampa would concentrate on convicting serious, violent criminals than to focus on some obscene material that would possibly be protected under freedom of speech.  Maybe this is because it is election year and some politicians are trying to make themselves look good for the community?

Censorship is BS and we all have choices as to what sites we should go on or not.

I happen to live here where the trial happened.. and heard it in the news.. and yes it is absurd.

The prosicuters actualy ordered the tapes.. and then went about to prosicute him for them ordering the tapes. *sighs*

Remember we are the town that flies a great big Rebel flag... *shakes her head* and wont allow any gay pride parades or festivals to be held with the county's consent being needed.

They forced the jurors to watch 8 1/2 hours of porn.. usualy human toliet porn. dude I dont wanna see that either. Of course they were going to rule that way. *sighs*

I really hate Florida.

even though I am bugging out about this, I think overall if there are going to several trials on this subject that it would be a good idea. It would force the issue for thousands of people who would rather turn a blind eye to it.  Though of course, could easily backfire.

abuse is hard to prove. that is one reason why they aren't going after as many.  And someone has to report it, for them to begin to do anything in a particular case.

Florida is on my list of places not to move to. (tho for a number of years had more to do with the commercialism, and high living costs.)

Per the article in the OP...these were Federal prosecutors, so the notion that they were worried about not being re-elected by the people of Tampa seems off a bit. 
And Florida has the reputation of a jury pool full of old snowbirds...ideal for these sorts of things.

I suspect the native Floridians could care less by and large.

I do hope that EVERYONE understands that we cannot take annother republican president. The far right dictator that has been squatting in the peoples house for the past 8 years has filled the government with far right bible thumpers that consider returning this country to some form of  bronze age taliban sexual mores to be their god given mission in life. Simply put; McCain will do more of the same, and Obama will appoint left leaning tolerant people who think more like we do. Remember that when you go into the voting booth in a couple of months!!

Tolerant?  Like 'Don't Ask Don't Tell'  and the 'Defense of Marriage Act' were tolerant? 

We already went into the booth and voted in a bunch of 'liberal' change agents....precious little changed once they got a taste of power.

I'd love to be proven wrong this go round, but I'm not holding my breath.

The law that Maxworld entertainment was being charged under was the Comstock Act. Do you even know what year the Comstock Act was passes? I will give you partial credit if you can name the corect century.

I keep saying that kinksters are more hung up on 'lets blame the bible thumpers' than they are worried about the REAL violations of our rights that go on. Post after post in this thread back me up.

Addressing several topics at once here.....Yes, the Comstock act is an ancient, probably un-constitutional law. Leave it to REPUBLICANS to use in in the 21st century to enforce "community standards". Here is a quick question: who controlled congress when the "anti decency" law was passed in 1996? Extra brownie points given if you can name the far right wacko senate majority leader. I just LOVE the way greedy kinky republicans think they won't be affected when their deranged BIBLE THUMPING brethern, who have hi-jacked the once grand republican party show their true colors, which is basically to continue the destruction of   the planet, and turn this country into an army of goostepping christo-fascists. I have said it before and I wil say it again, ANYONE who is a part of this community and who supports the modern republican party must have had distant relatives who had a "Jews for hitler" movement 60+ years ago.
