So sad...

Dude, it's custard with a burnt sugar caramel. An extremely simple yet delicious dessert. Flan is a Spanish name for it. The French call it Crème Caramel and torch the sugar on the top of it until it's hard like thin but crunchy glass.

Google is your friend...

It's a Mexican custard-like dessert. I've had it in restaurants south of the border. Seems to be based on egg...or have lots of egg in it, and it's usually (or often) topped with a sweetening sauce that appears to be made of brown sugar. Oh...and it's kinda jiggly like jello.

...hearsay...

Wow, so dramatic! Too bad you don't know what hearsay means...

hear·say. noun
1. Information heard from another.
2. Law. Evidence based on the reports of others rather than the personal knowledge of a witness and therefore generally not admissible as testimony.

So when people say "I did this...", "I saw this...", "He told me this...", "He did such and such..." they are relating information they themselves received through their own senses, the things to which they bore personal witness. That's not hearsay, that's a 1st person account of something. I read this thread and while I don't know anyone involved I counted a minimum of 4 people that could relate information in the 1st person from their own experiences. Again, that's not hearsay - in fact, we rely upon such evidence in courtrooms throughout the world. We need people to tell us what they saw, touched, heard, tasted, etc. That's how we find shit out.

I could swear this was explained before, but I can't bring myself to reread this thread again. Just get it straight please.

That's correct, however, that is under oath, this is not a court. And as an ex police officer what we have here is nothing more than "witness statements" subject to proof--but the poor defendant was tried and convicted.

Witness statements are a kind of evidence. There is no such thing as proof set certain - so "subject to proof" is a kind of meaningless statement. Subject to what proof? What kind of proof? People look at the available evidence and decide for themselves what it means - and that's not for either of us to decide, but up to each individual. "Convicted" is so melodramatic. People have every right to form opinions based on whatever evidence they find sufficient to their needs. Admittedly, this isn't a courtroom so we are limited to what people may post about and that's it.

Maybe I misread this thread, but FastLane didn't even contradict much of what was said against him. Can't we take him at his word in such a case? Certainly activities he confirms as true must be true. His main argument seemed be something like (paraphrasing here): "I'm not doing anything different than what everyone else is doing, so I'm cool." That's pretty lame. It's not a point of disagreement with anything anyone said against him. So if people choose to disassociate themselves from him because of things that were said againts him and which he often confirmed, how unfair is that?

Anyway, I don't care about FastLane. I don't know him. I generally find most of what FastLane says here overly flip. He seems to lack the seriousness I value in others. We were never friends to begin with.

Actually, I don't condemn him - I simply don't care either way.

You didn't misread the thread. You've caught the gist pretty well, I think.

(fast reply button used): nobody was tried and convicted unjustly of a thing. you provide the notary, i'll sign that my testimony is the truth, the whole truth, and nothing but the truth, so help me. in a heartbeat.

i can't say all of it came from my mouth, as some of it was said to me by a certain party i'll refer to as "FL" since i don't really want to spell it out right now. as it was confirmed by "FL" that what i said was true, you should perhaps let it be. sheesh. read the links and be done with it already.

Hearsay statements, in a non-legal setting, would be unverified rumors. In that context, the parties involved have directly said what was done. Not unverified rumors, different viewpoints. What we have here, if this were a Court setting, is first hand testimony, not witness statements. Witness statements, in a Court setting, would be from third parties. What we also have here is an admission of guilt with affirmative defenses. (Well yeah I did it, but...) As a former police officer, I would expect you to know that when a party pleads guilty and then sets forth a list of "yeah, but" statements, they are still guilty. It might serve to mitigate sentencing, but they're still guilty. I hardly think, however, that the "defendant" here would qualify as poor. I look at it more of laying in the bed one has made. If you say whatever it takes to get laid (or $13,000 as the case may be) including lying and misleading, some people will get the impression that you're a total scumbag.

I wasn't aware that I had emailed Irishmist.

Sure, call guido, especially if he is cute.

i didn't say that you had emailed misty, i said that your tagline reminded me to ask that people not. she has received a great deal of "hate email" and feels badly enough as it is. she didn't do anything to warrant any negative email.

i realize you were being witty with the tagline (and i actually am one who enjoys python), but as it spoke of a supposed to be happy occasion with the union of two people, i thought it a bit out of place, given the circumstances.

how about this for more suitable directness (like a telegram of old):

the tagline was of questionable taste. stop.

please let's all be mindful of the fact that there are some who may be a bit less than joyful right now, and not do things that will add to that hurt. stop.

don't kill the messenger. stop.

Tact, on this thread?

That was destroyed by the 10th post.

Laughter is cathartic.

"...one who lacks a sense of justice lacks certain fundamental attitudes and capacities included under the notion of humanity. Now the moral feelings are admittedly unpleasant, in some extended sense of unpleasant; but there is no way for us to avoid a liability to them without disfiguring ourselves. This liability is the price of love and trust, of friendship and affection, and of devotion to institutions and traditions from which we have benefited and which serve the general interests of mankind...by understanding what it would be like not to have a sense of justice--that it would be to lack part of our humanity too--we are led to accept our having this sense."

I am sorry to hear that Irishmist is receiving hate mail of any kind. It should be apparent to anyone with half a brain that she has little to do with this drama directly. She was pulled into it, unknowingly, just like the other branches. sigh.

Maybe the senders have less than half a brain? Only a sicko would direct any kind of animosity at her...or at girl4you2 or at you. You were all innocent victims. But then, attacking the victim is a time-honored defense tactic. Sleazy, but time-honored.

Hmmm. . . can we have the names of the persons sending these hate emails so that we can publically destroy them.

We could start a new thread and hang them out to dry.

Besides, I want to make sure that they do not get ANY of my yummy desserts. I am saving them for DesertRat and Mnottertail. *I think I am in love with both of them*

LaMalinche

--------------------------------------------------------

I am ready and willing to testify before the representatives of our Government as to my own opinions and my own actions, regardless of any risks or consequences to myself.
But I am advised by counsel that if I answer the committee’s questions about myself, I must also answer questions about other people and that if I refuse to do so, I can be cited for contempt. My counsel tells me that if I answer questions about myself, I will have waived my rights under the fifth amendment and could be forced legally to answer questions about others. This is very difficult for a layman to understand. But there is one principle that I do understand: I am not willing, now or in the future, to bring bad trouble to people who, in my past association with them, were completely innocent of any talk or any action that was disloyal or subversive. I do not like subversion or disloyalty in any form and if I had ever seen any I would have considered it my duty to have reported it to the proper authorities. But to hurt innocent people whom I knew many years ago in order to save myself is, to me, inhuman and indecent and dishonorable. I cannot and will not cut my conscience to fit this year’s fashions, even though I long ago came to the conclusion that I was not a political person and could have no comfortable place in any political group.
