He doesnt know yet what it is- but he is sure there is more to it then face value.

No need to create a conspiracy, since (as many articles have noted):

Souter has made clear to friends for some time that he wanted to leave Washington, a city he has never liked, and return to his native New Hampshire.

Clearly he was waiting until Bush was out of office.

Well, um, hell, maybe you are right.  At 61 I am also just another old white guy. However, what is that statute relating to discrimination on  account of age.  AARP power!

Since I am going out with a 76 year old woman, I guess my perception is difference.  The 76 year old would ride you to death and put you away wet.  So, I think Hillary can be president at the young age of 69.

It's not a matter of "can she function as President" but rather "can she be elected" or even "nominated".  She knows the answer is No.  McCain's age (72) was a significant issue during the campaign.

Same thing with Romney.  He might attempt to run in 2012 (age 65), but not 2016.  Handicap for Gingrich in 2012 too (69).

In politics, perception is everything.  i.e., if people remember it that way, then it still affects elections, rumor or not.  Is it just rumor that Obama is a Muslim?  Irrelevant, as many voted against him based on that perception--no matter how many times they were told otherwise.

McCain's age was a major issue in 2008, so it will be for any 65+ candidate in 2012 or 2016.

You aren't required to have judicial or legal experience to be nominated to the Supreme Court, so even Carrie Prejean or Perez Hilton could be nominated, for instance. Of course, there is that pesky Senate confirmation hearing and all...

Though I must admit Panda, you did hit on some very important qualifications that the Executive branch will need to fill....!
