If she truly fears for her safety, contact local law enforcement! Generally, she would not need legal counsel to initiate a Temporary Restraining Order (TRO), although I always advice to have counsel present. The TRO can be issued ex parte (without the other party present), but will not be enforced until the restrained person has been served. Generally, once a TRO has been issued, a hearing can be scheduled to show cause for a permanent restraining order. Blackmail could be prosecuted under both state and federal law. Again, if she fears for her safety, contact local law enforcement. As far as recording phone conversations, please be aware that recording a conversation without the consent of the other party is a crime in several states. Some of these states, but not all, make exceptions for such recordings when made if the individual is threatened with violence or extortion. Check your state law, don’t make a bad situation worse. When in doubt, contact local law enforcement or seek legal counsel.
