I am going to put this here as it will wind up political. Please excuse my writing this morning, as I have been up since 3:45 am.

I live in a 3 br 2 ba single story with a full basement. It slopes towards the back so that the garage opens into the basement area. The basement is partially finished, about half of it. Down there is the Master Suite (25' x 13') that I have built for myself. At about 3:45 this morning I woke up to the sound of the garage door opening slowly. I grabbed my .40 cal from the night stand, unlocked the trigger lock, put a clip in, pulled the slide back slowly to put one in the chamber, flipped the safety off, and then went to the door of my bedroom. I listened at the door for a moment, and waited a few seconds until I heard something in the room next to mine, that we use for storage at the moment. I slowly opened the door, leaving the light out to my room, and checked my corners before exiting. Gun raised, I slowly moved down the short hallway, stopped at the doorway to an unfinished room, and checked there, and nothing. I was just moving through the entry way into the basement foyer, when I heard something in the storage room again. I checked the stairs I had to pass, and checked the back door, keeping my back to the wall that the door to the storage room door is perpendicular to. I stepped up to the door, weapon raised, and standing in the room was someone dressed in a bulky dark colored coat (later learned it was navy blue), ski mask, and gloves. They were bent over and looking through some of our storage boxes, and had pulled out a small fireproof safe that was at the bottom. I quick glanced the room, which there are no hiding places from the doorway, and I saw no one else. I aimed my pistol center mass and said "Don't move I have a gun pointed at you." and the person stopped, and slowly stood straight up. Now they were turned mostly away from me, and I could not see their hands. I then told them "slowly raise your hands in the air so I can see them".

At this point my girl had come to the entry way to the basement foyer and asked what was going on. Keeping my eyes on the person I told her to call 911 and tell them I had an intruder at gunpoint. The person still did not raise their hands, and I could not see them. I told them again "Slowly raise your hands in the air so I can see them, and make no sudden moves." There was no waivering in my voice, as I have been in similar situations, but the person did not raise their hands still. I finally said "Look motherfucker if you do not raise your hands I am going to assume you have a weapon and shoot you." The person turned quickly and as they did their right hand was coming up from their waist area, so I fired three times.

They dropped fast, the sound in the enclosed room was load and my ears were ringing. My girl is screaming in the next room, and I moved up slowly to check the person. Blood is pooling up quickly on the concrete floor, and they are laying partly on their side, partly on their back, with their right leg bent under them at the knee. I could not tell if they were breathing, and decided it best not to bend down to check for a pulse. I stepped back and waited. I told my girl to call 911 back and tell them we needed an ambulance and shots had been fired.

It seemed like a very long time, but was only a few minutes I guess, but the cops finally arrived. Of course when they entered they yelled at me to drop my weapon which I did. They secured me, my weapon and checked the perp, who did have a pulse but they said faint. Three shots, two in the chest and one in the abdomen. They searched the guy, and found a .25 cal pistol in his right coat pocket, a straight bladed knife, and burglary tools.

I have been at the Sheriff's station making a report, and the perp is out of surgery but in critical condition. The Sheriff's Dept says no charges will be filed against me, and several against him. A 19 year old white male, that has a record going back years they said. I have been sitting here for an hour, trying to wind down, but if anyone reading this has ever been in a situation like this, you know it takes a while. As I was thinking, I am thankful that I am allowed to own a weapon, that I know how to use a weapon, and that I am a light sleeper.

So to all the gun ban proponents out there, fuck you. I am going to eat, try and relax, and get some sleep. Argue as most of you are likely to do, but I feel better knowing my family was kept safe. I am sure there will be second guessing on things to do, I have been sitting here myself and doing that, but regardless the outcome is better than what it could have been,

I guess I know why you said it would end up political, eventually it probably will.
I make what I think are good and valid arguements against keeping a gun at home, esp. in a night stand. I make no arguements against the right to do so - the second amendment is important to the freedom of this country.
Honestly, every arguement that I make against storing a gun at bedside does not apply to you. Your description was conscise enough that it is clear that you never would have accidently shot if that were your girl fumbling around in there, before you knew it was she. You were as careful as gun ownership demands. good for you.

I'm sorry too, and glad that you, your girl, and everything/everyone else that is yours is safe.  I'm sorry you had to go thru it.  I'm glad you had a gun to defend yourself.  I hope you are indeed able to get some rest today.

Orion, I am very glad that the both of you are okay.

It is tragic that a young man made such a horribly wrong choice that will impact so many more than himself. He put you in a position that no one should ever have to be in. Your girl will likely be upset for some time because of it. I imagine your neighbours will also. And on the flip side, I am sure there are people that care about him and are worried about his wellbeing. It basically just sucks.

No one should have to go through any of that.

Wow...i am so very sorry this happened to you. Thank God you and your lady were not hurt physically...and the emotional recovery will take time.

Actually Orion, congrats, you have changed my mind. Thank God you had that gun, I have no doubts that you saved your own life as well as that of your girl by having that gun.

While I wouldn't have a gun in my apartment as I would be more of a danger to myself than anyone who might try to break in, my situation is different. I live on the top floor of an apartment building; my only concern is the door to the stairs which is about 2 feet from my door and I am required to have my back to it when I open my door.

All that said, there have been times when, as a female living alone I do wonder how safe I am....and for all you who will say that a woman is just as good at protecting themselves from a preditor save it. I've been the target of one and really you don't know what you would actually do until you are actually in the situation. I thought I could and would fight back but that was, in the end not so. Anyway, while it would be difficult to get up here, it wouldn't be impossible.

Orion I am thankful that you had the gun, things could have ended very differently if you hadn't had one. I have no doubt that you did the right thing and I have no sympathy for the asshole who broke in, he got what he deserved.

Orion I am relieved and so incredibly glad you had that fun with you, and took care of your home, your girl and yourself in exactly the right manner. I agree wholeheartedly, I am never ever without a loaded .45 and I refuse to even argue the points anymore. You are right, fuck them. I laud your bravery, calm thinking and rational manner. Good job, I know you and your girl will be fine, and she's lucky to have a man like you to protect her. Job well done.

Can't sleep, but that is no surprise. My girl is doing okay, though having to stay at the house while I was taken in, right after this, has added to her trauma. She is curled up on the floor beside me at the moment, getting some sleep. My 4 year old son is laying on the couch watching Disney channel. My Mom, the Granny, is laying on the other couch (she is bed ridden and the living room is where she stays) snoozing as well. My Dad (the Papa), is sitting in his chair looking out the window. Look at all of them and know I did the right thing.

Sharing things here may help so..... So far while at the Sheriff's Dept I suffered from the tremors, those were expected as this is my fifth shooting involving injury (was due to the line of work I was in for a while). Drank lots of water and a few cups of coffee while I was having my report taken and answering questions. I asked them to keep things as quiet as possible, but I guess there is only so much that can be done, as my phone has been ringing with reporters wanting a statement or interview. I am declining all of that, as I am a pretty private person. The Deputies said there is no way to keep it off the blotter, so it will get published somewhere eventually (I will not be posting any links because of privacy, and at least two people on here that have malice towards me). The Deputies were all very nice, and the one that drove me home related his first experience where he had to shoot someone. In times like this, I suppose it is human nature to share our own experiences to make a connection and offer support.

I have two Deputies that live in our rural sub-division, and both have stopped by while I was outside on the deck smoking a cigarette (been smoking like a train). The nausea came about 30 minutes after I got home, and stomach is empty now (that was expected as well). They kept my pistol, and said I would be able to pick it up in a few days. Have my .380 till then, which I need to clean and go by Wal-Mart to get a trigger lock for.

Thanks to all for the well wishes. I usually do not relate this much about my personal life, so it seems odd, but maybe some good can come from this. The young man did not have any violent crimes on his record, and may have some affiliation with a suburban gang that is taking some roots around here. We are not sure why he went in the storage room, and no one outside the house would have seen the old firesafe down there, which has nothing in it except old papers.

Anyway, enough rambling for now. Going to get some air and a cig.

All this still seems surreal, but the times before it did as well too. Reminds me of the detachment I had when I was younger and did LSD.

Alternatively, the little shit gambled you were bluffing and lost. I applaud your actions, and though the outcome is regrettable its absolutely clear it occurred only because of the failure to comply with instructions on the part of the little shit. The above is what one might expect to hear in a UK Court, shortly before you were taken down - that the US system has evolved to recognise (what I feel is) a better standard of process in such instances merely indicates the failure of the UK system, whereby you'd by now be in deep do-do, whether you'd shot, stabbed, clubbed or done whatever else to him.

I hope you and yours recover from it all soon; the psychological impact must be great, whether its realised now or in the future. Dont be afraid to admit it and work through it with whoever can help.

Not only am I glad to hear you and your girl are ok, I have to give you full respect. Not only did you handle a dangerous and frightening situation with an amazing amount of self-possession, your actions were a textbook, spot on perfect example of appropriate force and properly exercised rights to home and self defense.

I think there are a lot of things in your experience and actions for both sides of the political question to think on and learn from.

I'm sorry that you and your lass went through such a thing, but glad that you had the presence of mind to remain calm and do what was needed.

I hope that you, and yours, heal from this and that the fall out, be it from press, or anything else, does not add too much to an already emotionally difficult situation.

I'm glad your family and you are well although traumatized. I do wonder at why you didn't call the police first thing instead of waiting so long. Having neighbors who are police, I would have expected you to call them first for help. Or aren't you on close enough terms with them to do so? My mother in law has for a neighbor two doors down, a state trooper. He is happy to help out if she calls and wants the neighbors to call 911 first and then him, in case he isn't home.

You know I still can't help but think that if he had just put his hands up so I could see he was unarmed, it would have ended much differently. While it was going on, I had to keep reminded myself to breath fully, as I was holding my breath and short breathing a lot. Calm? It may have seem so, but it was really a strain to do so.

Had plans to go shopping today, but going to stay around here and wait for the crash that I know will happen sooner or later. My oldest son is on his way home, to watch over things.

Live in a rural area, and have had critters of various kinds come in through dryer vents, under the siding, and other things. I was not positive it was the garage door until later. Not to mention that there are several people that live here, so I was not sure if it was my son just getting something from our tool area. Before I saw the guy I kept saying to myself it was probably my olds son, a possum, raccoon, or something. We had extremely cold temps, so the likelyhood of it being an animal was muh greater. If we called the Sheriff's Dept for every sound out here, that we cannot identify, they would be making a lot of trips.

But you know, I asked myself that question too, and wonder if it would have made a difference. Being in the rural smi-rural area of the county their response time is not always the best, especially on a Sunday morning. None of that went through my head at the time, I kept thinking it was an animal or my oldest son.
