A mandate is a requirement. What Sanity, and most of the republican party is stressing is that health care is now mandated. Got that part. What they arent getting is that not everyone is required to purchase that insurance. If you have insurance, this wont affect you at all.

As far as being forced to purchase something... does everyone forget those little ID cards you need to do just about everything from travel, to work, to bank accounts, ect.. cost money too?



I have no doubt its less than the insurance companies spent on fighting health care reform.

Now, as far as forcing people to pay... you didnt address what i said about ID cards. Curious. Its the same thing... apples to apples.

If you dont have insurance, you must purchase.

An ID card is needed for just about everything... banks, travel, insurance.. even federal programs.. work.. hell... i need one just to get into the local casino or the bars.

If you dont purchase insurance, you get fined (taxed). They could say you dont get any kind of care... but that isnt what is wanted, or needed. No one will deny you emergency care.

If you dont have an ID, you cant get some of the services you want, or need, including health care. And that is your fine.

Still, David Freeman Engstrom, a constitutional law expert at Stanford University Law School, said all these measures face significant legal hurdles. Freeman said there is the question of whether a state has standing to bring the lawsuit, or if that role is better served by an individual who could show they were harmed by the mandate to buy health insurance.

Idaho's law faces an even bigger challenge, he said, by setting up a direct conflict with the supremacy clause in the U.S. Constitution.

"That language is clear that federal law is supreme over state law," said Freeman. "So it really doesn't matter what a state legislature says on this."

37 states are working on the same type of legislation, which thats a lot of muscle. Just because the Democrats feel obligated to go marching off the cliffs for Obama doesn't mean the states have to. What we have here is one more sign pointing to how this legislation is wildly unpopular, and that it's never going to stand up.

the current legislation is wildly unpopular, not healthcare reform.

Now, having said that if there is a majority of states that do an end run to see that there is no federal mandate to coerce (no-fault) style health insurance, I am for it. Regardless of what you may have thought.

Having said that, and in that way Tom, you would have damn near universal agreement.

But to link anything other than the current pending bill to this states legislative efforts to defeat the mandatory buy, (because what we wanted was reform in this matter), you would get damn near universal agreement. Or, at the very least a grudging acknowledgement of a reasonable viewpoint.

Will these be the same states that "refused"  federal bail out money?

How strong these folks are in the face of federal oppression. If I were them I would refuse any and all federal money.

That would teach us!

I hear you.   I hope PA does too.
However PA is doing the reverse.

It floors me that educated buffoons here on this list- defend a contract- that they have not read.   2300 pages of gotchas.   With any bill there is a quid for quo.  What do you pay and what do you get in return.

Yet- no one here is the least but interested in what federal reserve notes they will be forced to pay.

The Amish will not be subject to this law.

Daddy always told me to READ what I sign.
