The Arizona Senate passed new legislation Monday....the bill was sponsered by a Republican senator who not long ago was viewed as an eccentric firebrand...Russel Pearce.Coincidentally perhaps Mr.Pearce's son and Pearce himself both had the misfortune of being wounded while serving as Sherrif's deputys by illegals....of course these incidents happened 20 years apart but it would seem the good Senator has a good memory .
Passage of the new law would allow,amongst other unsavory things, authorities to demand proof of entry into the United States from anyone suspected of being in the country illegaly.
Seems on the face of it un-constitutional....opinions?

Is this not something right out of Orwells's mind.....on demand,and minus "probable cause"(other than looking latino?)one will have to prove they did not break the law.
It will be interesting to hear what the proponets of enforcing immigration law think about this new proposed law(Popeye where are you)...we will(or at least Arizona will have) suddenly leap from a society where the authorities must prove you have commited an offence...to one where you must prove you didn't.
Fucking scary....

It depends who the "authorities" are? ICE can do it without new law. Can security guard do it? Some authorities should be able to do it. For example Social Security administrators, IRS and so on. Police on street perhaps not, but if somebody has been arrested for another crime, a police department should do it (it is not the case in sanctuary cities).

Mike, as usual if our federal govt. was doing their job this state law wouldn't be neccessary would it?

Sorry Fellow,I should have bbeen clearer...the new law would give authorities(re: cops,leo's) the authority to stop someone and with no other provocation,no other law enforcement activity going on....ask to see proof of legality.
Popeye irregardless of whether or not the Fed is doing it's job this is still Orwellian....prove you have not violated a law! Whats next....prove you aren't thinking of violating some law?

This is just too funny. I would expect a main "wetback supporter" (The catholic church) to rail against a law like this. I'm glad they passed this-Arizona is one to the border states these criminals pass through.

They sooner they get stopped and deported-the less they can suck out of our economy.

How many times during the year does your police department have roadblocks announced to stop drunk drivers or those not using seat belts? Do you ever hear of them arresting illegals at these?

I'm extremely concerned about illegal immigration and the effects it has on the U.S. economy.  I absolutely think steps need to be taken to curb the influx of illegal immigrants.  This particular law is one of the stupidest pieces of legislative garbage in recent memory.

What does it actually accomplish?  Very little.  Deputy Cornfed T. Banjostrummer is now authorized to....do what exactly?  Prance around in jackboots and demand to see papers from anyone he suspects of driving while Mexican?  Cause a certain amount of hassle and inconvenience for a few people?

Laws like this allow grandstanding jackasses to send newsletters home to their constituents full of swagger and tough talk about how they're cracking down on the by God immigrant problem in the great by God state of Arizona in the United Goddamn States of by God America.  Everyone feels better.  Things continue to fall apart and nobody pays much attention because didn't the local newspapers and radio hosts just say that State Senator Peckerwood had fixed the immigration problem?

The single most effective way to end illegal immigration is to punish people who hire illegals.  I don't mean a slap on the wrist and a wink and a fine and "Oh don't do that again and we'll see y'all in church next Sunday okay?"  I mean deport the workers and make the people who hired them (as gardeners, as undocumented domestic help, to work in some sweatshop, whatever) wish to God they'd never even thought about considering hiring an illegal worker.  I mean burn it down and salt the fucking earth.  But nobody is willing to do that.  Do you know why?  Because too many of the people hiring illegals are good God-fearing capitalists who vote, who go to church, who give money to politicians.

So instead, we get moronic half-measures like this, specifically designed to make people feel like Something is being done when the root of the problem is never being addressed.  Sadly, it's unbelievably effective.  This law will inconvenience a few people, piss off a few cops who have to process the paper work, and eventually be struck down as unconstitutional.  Then what happens?  People get to vent their spleens at the ACLU, at the damned activist judges, at those pesky liberal politicians....at all the familiar targets.

And that's how to talk tough, make the problem worse, build up a campaign war chest, get reelected, and live the American dream of continuing to get elected while continuing to make things a little worse than when you came into office.

Merc your two examples are legitimate law enforcement activities,and in the case of the sobriety checkpoint the constitutionality question has been asked and answered...the protection arises from the fact that every car goes thru....in other words they aren't just checking cars driven by Hispanics...and by the way I have never had to produce my license at a DUI checkpoint....not being inebriated means you get waved through.
Popeye the failure of the Fed does not mean Arizona can violate the Constitution nor take us farther down an Orwellian rabbit hole.

Yes jack the future will be very interesting.....if Arizona is any example very scary too.It is amazing that the same voices that scream unconstitutionality where health care if concerned are totally cool with this incursion of civil liberties....I guess the Constitution and the Bill of Rights is inviolate only when they feel threatened.
Pretty much on the mark Orpheus....how many more Sheriff Joe's will this stupid legislation turn into cult hero's for the incredibly dumb and stupid crowd.

I agree about punishing the people who pay illegals. If that stopped-they would be forced to leave. Problem solved. have they figured out if a decent improved fence will actually WORK? Or do we need to beef up the border patrol?

So my buddies from school, that "look" Mexican, but were born in South Central, can get stopped anytime, anywhere in AZ and have to prove their citizenship?  What a crock of shit.
