This country has a history of protecting the legacies of past presidents and administration officials as much as possible. Plus, Obama would like nothing more than to sweep the illegal actions of the Bush WH under the rug--the ones he is not continuing that is. I don't see this case going anywhere. This decision will be appealed and eventually the Supremes will decide Rummy was in his right to hold a US citizen incommunicado.
