Sadly, as I wrote on another thread ("Go To Jail - Or Go To Church?"), the clerk and her advocacy group will claim this is another case of a Christian being "persecuted" for their beliefs in order to raise money for the advocacy group and to reinforce their sense of "victimization".

Although the vast majority of Christians do not believe this or act in this way, extremists (usually from Assembly of God and Southern Baptist Convention churches) take the position that any time an individual, an organization (public or private) or a governmental entity does not fall in line with their "theology" - it is a sign that they are being "persecuted" for their beliefs. Even if one of their group tries to hand you a pamphlet on the street and you say, "No, thank you" and refuse to take it from them - they see it as you "persecuting" them for their beliefs.

It's not her right to her beliefs that anyone is questioning. It's her right to choose which laws she will uphold and which she will not. She can hold any beliefs she wants in the privacy of her own home. As soon as she takes a government job, she is required to fulfill the obligations of that job. If she cannot do so because of her beliefs, she has to resign.

I can't say I agree with this woman's beliefs, but I must agree with her right to have them.

Yep. Still, I doubt that she'll feel that her faith requires her to do so, sadly.

I can't say I disagree with you.  According to the article that kalikshama provided, two clerks in the state did just that.   I half wonder if Ms. Belforti thought she wouldn't have to face the issue.

I'm a little more forgiving of her current term since the law changed.  Can't say I think much of her seeking re-election since she specifically knows that (according to her beliefs) she can't fulfill all of the duties of the job.

The beauty of that is that she likely won't be elected for that very reason. Evidence, in my opinion, that there is a God, and when she is defeated, he will have spoken (yes, that was tongue in cheek).

Town Clerk in NYS is an elected position. If they don't hire a full-time deputy clerk to make sure people can get licenses issued in a timely manner, then I suspect they'll just elect a new Town Clerk. One who won't waste the town's money on needing to hire people because she can't fulfill her elected duties.

That aside, I wonder what she'd do if you showed up at a town meeting and recited parts of the DIY D&C manual into the record. She's gotta maintain those minutes by law....

The job isn't full time for anyone. The clerk, deputy or otherwise only works nine hours a week. So in that sense, no one can get a license at any time during what we consider normal business hours of 9-5 Monday to Friday. The clerk's office as a whole, is only open for business 3 days a week for 3 hours on each of those days.

They don't mention why the deputy clerk wasn't there at the time the couple went in. Was she merely out to lunch or running to the post office? Perhaps she just ran to the bathroom. It wouldn't be terribly uncommon for someone not authorized to do anything but file and answer the phone cover during such a break. If that were the case, anyone coming in at that time would have to wait.

I'm not saying that is the case, and certainly with them only working 3 days a week for 3 hours each day, those kinds of errands (except going to the bathroom) would logically wait until the office was closed. I'm just saying that the article leaves out what to me is pertinent information (like whether the couple is from Miami or a neighboring town).

And yes, I believe she should be forced to resign her position. I also believe she should be fined for abuse of power and deriliction (sp?) of duties. Then people should boycott buying her cheese.
