Oh come on... the car was going maybe 1 mile an hour don't be silly. This all escalated when the guy started yelling and beating on the hood when all he had to do was step aside.

How did the man know he was going to stop? How fast does a car have to go to cause damage? You catch a glimpse out of the corner of your eye and you react... he pushed her out of the way and got pissed. Its a NORMAL reaction. Again, Pedestrians have the right of way. The man had the right to yell... the driver fucked up by threatening him with running him over.... the guy hit the roof.. and the driver made good on his threat.

You need to actually watch the video instead of going by reports. The car was way too close... assault and battery with a deadly weapon has a good ring to it.... not to mention attempted vehicular homicide.

Funny tazzy but that's what I said...soooo instead of stepping aside as any reasonable person would do when a car is slowly coming towards you this punk decides it is ok to pound on the hood...Now where in any of my posts did I say it was ok for the driver to run the kid down?... I said the pedestrian had some of the blame for the whole damn stupid episode.

Butch

This is such bullshit. The fuck in the Benz gets right up on the two folks walking before he stops. That's a fucking threat to their lives in my book. The woman interviewed at the end said the shitbag was yelling out his window at people. And the guy wasn't pounding on the hood... he smacked the hood. Twice, it looks like.

Fuck in the benz should be glad OOakland folks aren't armed. If it were me, and I was carrying, and some fuck in a car did that to me, I would have defended myself.

You're as wrong about this as you are about drugs, sonny. You should be ashamed of yourself.

tazzygirl -> RE: Ummmmmm ... someone was disputing numbers in Oakland... (11/3/2011 7:34:55 PM)

He didnt watch the video. he got it from news reports.

kdsub -> RE: Ummmmmm ... someone was disputing numbers in Oakland... (11/3/2011 7:36:14 PM)

Tazzy for all we know the man could have directly threatened the driver we don‘t know all the circumstances...It is not normal in my town to beat on the hood of a car when pissed.. pissed does not justify violence. I have never tried to say the driver was not at fault...have I...show me where I've called him anything but a criminal.

Any normal person would have stepped aside ...not this asshole...he was complicit and partially at fault and lucky he did not get someone killed let alone himself.

Just wondering...does the book say it is ok to verbally assault a driver then beat on their hood?

Butch

Not any book I've seen... course you were there and  saw that happening.
But let's be a little more realistic for a second.
What when they're running you over? I think that falls in the category of the person being run down and yeah in that case you can. You're also supposed to scream shit like "NO, GO NO" as the car rolls over you.

We know of course in the BOOK of STUPID it does say to drive through protest or riot NOT EXPECTING TROUBLE... It Probably also says  flip em the bird and spit, and yell "get a fucking job" as well cause half the IDIOTS that were driving around down town.

But Butch, in your race to create this 'moment of common sense' or whatever atmosphere you've been going for in this thread, you missed one CRUCIAL thing. This was on TV in every newspaper and people were almost given a 'weather alert' kind of warning. People KNEW what the goals were in advance and contact was in fact avoidable. So if you're a motorist and you decide to put yourself in a bad space knowing basically what's waiting for you... Aren't you really about as bright or deserving of 'good fortune' as the asshole who sails off in a storm that's been given a woman's name?

Exactly and ANY normal person would run the person over because he was verbally assaulted, beating on someone car hood, or you piss them off. Thats how life works, its called being civilized.

You're right... and the driver may also have threatened to "drive over people" as one eye witness said. SO ALL WE REALLY KNOW IS THAT A MAN, IN A MERCEDES, STRUCK TWO PEOPLE WITH HIS MERCEDES. THAT THE TWO PEOPLE WERE TAKEN TO THE HOSPITAL AND THAT THE MAN WAS RELEASED WITHOUT BEING CHARGED OR EVEN PROPERLY INVESTIGATED.
   That's all we really know.

tazzygirl -> RE: Ummmmmm ... someone was disputing numbers in Oakland... (11/3/2011 7:54:31 PM)

I simply know what I saw on the video. I dont care what the driver was yelling, or what the other man was yelling... because they are just words.... thats it... JUST words... the actions of the car, and the driver, was one of the threat of assault, then actual assault.

Lawyers will have a field day.

kdsub -> RE: Ummmmmm ... someone was disputing numbers in Oakland... (11/3/2011 7:59:01 PM)

No we know more...the kid beat on the hood of his car... and we know the driver then ran them down...both actions are wrong even though one action was life threatening and penalties should be assigned accordingly...But neither action should be forgiven or ignored.

Butch

Same scenario only say it's  a Boston Bruins game. You threaten somebody crossing Causeway St right after a game (specially a LOSS). Here's what happens. Three members in the crowd break your mirrors off and take out every inch of glass in the car while running on foot along side of you while you try to weave through the traffic. If you're REAL LUCKY, they you don't get caught behind the cars at the light at the Tip O'Neill building and they start actually tuning on you.
I've seen that happen in Boston. Trust me, anybody raising a big stink on behalf of some smarmy fuck in his mercedes indulging his bogus (based on the mercedes HE had) 1% fantasies... Somebody should checked to see if the guys pants were down.

What part of "Pedestrians REALLY DO have the right of way in CA" can you not grasp?

Why don't you, you know, actually WATCH the fucking vid? The guy didn't "beat on the hood"... that is just you PMSing or something. Hysteria... the Vapors, I don't know... but the guy DID NOT "beat on the hood". Stop that lie right now. The ratfucker in the Benz committed attempted assault with a deadly weapon.

Then he actually assaulted the guy with a deadly weapon. CA Penal code 245a(1).
http://www.shouselaw.com/assault-weapon.html

This can be a serious felony under the law. And you are defending the ratfucker? To the point of calling the guy walking across the street a "punk"?

WTF is wrong with your head?

Lucylastic -> RE: Ummmmmm ... someone was disputing numbers in Oakland... (11/3/2011 8:08:38 PM)

THey have pics of the guy floating about, with his Name and license plate and a pic of his face, and a report that he was relocated to a different are and arrested.
COming in trhru twitter right now.... obviously I suggest waiting on an "official" source.

If the guy was close enough he was pushing people on foot and he's lucky it wasn't somebody street wise ... but this HOKUM of "well maybe he was threatened"... please just spare me. That's like saying we should greet everyone with five basic tones in case they're extraterrestrial.

Fact is If you had a car and you drove downtown yesterday, you may very well have been either a complete moron, in which case I heard they flagged cars with families through lanes made in the crowd at the Oakland bridge for instance and I was on the news that the drivers of cars and trucks alike honked their horns in support. OR you were just trying to bust balls or pushing the envelope JUST LIKE the guy in my example of hockey fans at Boston Garden ... in which case, fate really smiled on that asshole. And you're just sweetening his deal.[:D]

I dunno, Brother, looks like an E320 just off hand. It's about the same chassis length as my 94 E320 droptop... ain't no Renntech machine, that's for damn sure.

kdsub -> RE: Ummmmmm ... someone was disputing numbers in Oakland... (11/3/2011 8:13:46 PM)

How many times must I say the driver is criminal...what the hell do you want? But that does not relieve the pedestrian from blame in escalating the situation...If you can't understand that then I'm done answering you because we will never agree.

Butch

kdsub -> RE: Ummmmmm ... someone was disputing numbers in Oakland... (11/3/2011 8:17:46 PM)

You see you are just like tazzy... you don't know what was said...I don't ...you may be right ...or...wrong...imagine that... There are only three facts we have to go on...One... the pedestrian was within his rights to walk across the intersections...Two... the guy beat on the hood...and three... the driver ran two people down. All acts were against common sense and the law.

Butch

You mean the caught him lingering in the area afterward?  And he was then picked up? Or did they send him down to the other end of the street to voluntarily surrender? I am actually in chat with a guy who would like to know. I mentioned what Butch was saying and he and I'm not even gonna quote what he's saying back. suffice it to say... he finds the reasoning humorous.

it's a minor point but
It's a 16 year old car

Let me add to that ... It didn't look manicured... you describe a car you take care of.... I'm from newport county in RI half of us had Dad's old Mercedes in Highschool... Not me. I had a 68 goat

Ummm I was referring to your inference about not knowing if he was threatened. In my opinion it was immaterial. You can't hit pedestrians and YOU DUMB AS A FUCKING POST if you drive into an area with riot potential... and in my opinion dumb as post if you waste an hour of everyone's time debating nuances of the scenario such behavior created.
And now I am as flawed in my thinking as Tazzy. THANK YOU FOR THE COMPLIMENT SIR. Cause she and Lucy are two of the most astute people I have met here.
