I, up until very recently, had a lot of rape fantasies...I until I actually got raped by a friend. Realities never ever live up to Fantasies, in reality being raped hurts a lot, more so after the physical pain is gone, it is emotionally damaging. hell it shook me to my core.
when people think about rape in a fantasy sense they see it as a slow drawn out event with a mysterious masked man who has rock hard abs and smells like - insert favorite scent here-. but in reality its usually a good friend who doesn't understand the words "no", "Stop", leave me alone!" or "your hurting me!"

My advice to the OP is, think with your brain not your cock. pay a prostitute if you have to but don't do what my ex friend did and take away part of a woman's innocence, because its something she can never get back. You will damage her more than you will ever know.

I dunno-a kinky notary.Maybe a lawyer who wore two hats.
And even then, I'm not sure they would. I dunno if a notary can notarize an illegal document. That's outside my realm of knowledge. The lilone may know. She was gonna be a notary once.
But a notary/lawyer could establish identity, they are both considered officers of the court and thus their word/testimony would carry weight as well as verify that she consensually agreed and requested said act to be committed of her own free volition and will. And they could testify to observed behavior, thus abetting establishing sanity.
Which may or may not be decent protection, depending on jurisdiction, local politics and how the police and prosecutors determined to pursue the case, which is all completely wide open.
But I would seriously want some hard ass core protection ensuring who and what she was and wanted before I ever ever walked down a road like this...
(Not that I would. I'm all about consent-it's what gets my rocks off so I'm only speaking theoretically here)

A notary cannot notarize a document that states illegal activity. If a notary does, they could face a misdemeanor.

Actually, if you go into a lawyer/priest/psychiatrist/psychologist and say you're going to commit an illegal act, they're under legal obligation to report to authorities. This may be quibbling semantics a little, but for the "rape scenario" to be an illegal act, it would have to fall under the statutory Penal code definition of rape. If the scenario is consensual and agreed upon between the parties, then the planned scenario is not "rape". So there would be no requirement that a lawyer or therapist warn and a notary could operate. Where I think OP would really run into trouble, assuming the requesting women were real etc., is if one changed her mind during the enactment. Still, if that happened, the entire factual situation would present an inordinate problem for a prosecutor, hence the second question I suggested OP ask of the lawyer.

I'm a lawyer, and if someone like OP came to me to ask how he could commit rape and avoid prosecution, I'd toss him out the door. However, if OP came to me saying he and a woman want to play out a rape fantasy and what safeguards could he adopt, I would absolutely assist him. It's that distinction; I wouldn't help anyone commit a crime.

Its certainly got risk but if your nutcase detector works well...go for it, but if not...

Lastly, you need to understand what elements are hot and which arent for each person. make em write out a fantasy or read one of yours and explain what does and doesnt work.

Aswad, your name really fits you. I NEVER SAID he deserves to be raped, NO ONE "deserves" to be raped. I also NEVER said I found it hilarious and, as a matter of fact, rape is NEVER "hilarious," no matter who it happens to. I was saying that's what could happen if he actually carried out this fantasy and what a bad bad idea it would be to do it. I meant it was just a BAD idea to do it because that's what might, probably, happen to him if he did.

actually this not so much a question of semantics but trying to walk a very thin line.

On one side... you are right. To engage into a planned consensual scenario of fantasy rape is NOT Rape in the legal scene of the word.

HOWEVER, for some this scenario needs to feel almost real and people need to get very close to that edge to get the rush, pleasure, enjoyment they are seeking from the scenario. Too close to the edge and one is risking slipping over and someone calling foul... or you are not close enough to the edge and one cries boredom.

This is not wide path to walk and it is also not straight path either. Not knowing your partner to any significant degree is only going to make the path more difficult to navigate. I done this before and would never even attempt to walk down this path with someone I don't know very very well.

I feel compelled to add my two cents on this. I have done a "simulated forced/rape" type scene before. Thing is, I knew the other part of the scene well. She and I had dated for over a year before we were comfortable with attempting it. I would have to have her permission to proceed before she went to sleep. If she said "no" I honored that and would not proceed that night. We had engaged in sex many times before that and had established what was acceptable and what wasn't. We also agreed on how things would be pursued, if anal, I had to use lube, if vaginal, we used appropriate protection.

I have read the case that is so popular to be mentioned in this forum, yes I agree that it is a major concern and you have to know your play partner well enough to know proper limits. To attempt it with a stranger like that is extremely fool hearted and extremely dangerous. I was raped in MS by a staff member, lets just say that he still bears physical scars from being on the wrong end of my temper. It's a long story and not a pleasant one. I think I made my point.

As for a legal notice, it has to be very solidly placed to show she gave consent, you cannot rape the willing.

The issue still boils down to how well you two know each other, respect each other's boundaries/limits and how long you two have know each other. First meet right out of the gate, you just stepped in front of a loaded howitzer pointed right up your own ass.

I have rape fantasies all the time, but the only one I would live them out with is my Master, It's a very touchy thing when you think of the legal issues you could have with strangers. Maybe do this only with a sub you plan on being with for a long term, and get to know and trust one another. That's my advice :) good luck
