But he did say that "the FBI cannot recommend prosecution on criminal charges" Not that " a prosecutor would have a difficult time bringing charges."
But it will be interesting to see what IS written when the talking points are out...
There is evidence the statutes were violated, Comey says, but no one ever gets charged for that so Hillary shouldn't either.
She's going to get away with it. Not because anyone thinks she didn't do it. The FBI director knows damn well she did it. He even said in the presser that her statements about a) never sending or receiving classified e-mails; and b) turning over all her work-related e-mails were clearly not true.
He absolutely lambasted her lack of care for the security of classified e-mails, even up to and including the use of non-secure devices when overseas, when it would be especially easy for hostile actors to gain access to her devices - which Comey acknowleges may well have happened.
But in referring the matter to DOJ prosecutors, the FBI recommends no charges. Why? Not because there isn't evidence she broke the law. There is. But because typically no one gets charged on the basis of such evidence, so Hillary won't either.
His quote:
"Although there is evidence of potential violations of the statutes, our judgment is that no reasonable prosecutor would bring such a case. In looking back into our investigations, we cannot find a case that would support bringing criminal charges based on these facts."
So in other words, precedent is that the DOJ overlooks such cases unless they can show that the illegal handling of classified material was for the purpose of committing treason or something like that. Not just because there is evidence the law was broken.
Another detail Comey revealed: From the 30,000 e-mails the FBI reviewed, 110 e-mails and 52 e-mail chains have been determined by the owning agencies have been determined to have classified information at the time they were sent or received. And eight contained top secret information, while 36 contained secret information.
Hillary flat-out lied about that. Comey goes on to say that when someone is caught acting so irresponsibly, there would normally be some sort of sanction: "Those persons would be subject to security or administrative sanctions, but that's not what's being decided here."
But not in this case. In this case the action being contemplated is to make her president.
Hillary certainly did not get off scot-free as far as what Comey said. He ripped her to shreds for the way her schlock, homebrew e-mail server was set up and maintained, and for its woefully inadequate security. The fact that she will apparently not be charged should not fool anyone into thinking she didn't break the law or that she did her job well.
