Maine lawmakers divided on bill to criminalize female genital mutilation

AUGUSTA (WGME) -- A bill to criminalize female genital mutilation in Maine is expected to die this session, with the House refusing to take it up again.

Lawmakers are unable to agree which version of the bill to support, but both supporters and opponents agree this isn't the last we'll hear of the divisive issue.

LD 745 would criminalize female genital mutilation, or FGM, making it a Class B crime to perform the procedure on someone under 18, also allowing their parent or guardian to face charges.

Rep. Heather Sirocki, R-Scarborough, introduced the legislation.

"There are absolutely no medical benefits at all to this type of procedure and it is not similar to male circumcision," Sirocki said.

She said Maine is a high risk state, with MaineCare billing last year showing eight instances of providers treating problems resulting from FGM.

"The specific law is wanted by the Maine Prosecutors Association because there was some ambiguity around this and there was a case that failed on appeal because it was not specific enough," said Sirocki. "The prosecutors really feel they need that clarity to specifically prohibit this and that's what they're asking for."

House Democrats amended the bill to just establish outreach and education on the issue, a move supported by the American Civil Liberties Union of Maine, which released a statement saying in part, "There are already severe penalties ... This bill is nothing more than an attempt to single out behavior that is commonly attributed to certain religious and ethnic communities as different from other forms of abuse."

Senator Mark Dion, D-Portland, is against the practice, but also opposes the bill. He said FGM could already be prosecuted as an assault or sexual abuse.

"There are some of my colleagues who believe whenever we discover a new set of facts, it requires it's own law. I think the beauty of the criminal code is it can be applied to changing fact circumstances," said Dion.
Sirocki said she expects similar legislation to be presented again in two years.

After a lengthy and emotional debate, the House voted 76-71 against creating a new crime of “female genital mutilation” – on top of existing federal and state prohibitions – for a procedure estimated by the United Nations to have been performed on at least 200 million girls and women in 30 countries. Instead, House Democrats supported a version that directs the Maine Department of Health and Human Services to establish outreach and education programs featuring “culturally specific services for communities in the state wherein which female genital mutilation of minors might be practiced.”

Rep. Rachel Talbot explained why she amended the bill:

Rep. Rachel Talbot Ross, D-Portland, introduced the amendment to change the bill to require outreach and education programs aimed at communities in Maine where FGM “might be practiced.” Those programs would include support networks for victims of the practice as well as “culturally sensitive professional training.”

“We all share the same goal, and our shared goal is we don’t want female genital mutilation to happen,” said Rep. Charlotte Warren, D-Hallowell, who noted Talbot Ross’s amendment had the support of national policy groups, victims advocates and the immigrant community.

Those who opposed the original bill believe the laws in Maine are more than enough:

The debate over the bill, L.D. 745, was not whether the practice happens worldwide but rather whether it is occurring in Maine, particularly inside the state’s growing communities of African immigrants.

“I do not believe that it is happening in the state of Maine. I truly do not believe that,” said Rep. Lois Galgay Reckitt, D-South Portland. “And I believe if it was happening, it would be prosecuted vigorously by the federal (laws) or by the abuse statutes in this state.”

However, Circa reported that the Maine Prosecutors Association supported this bill because it would allow the prosecutors “to clarify and specifically identify” female genital mutilation as a crime, “with a clear level of crime attributed to both the person doing the cutting as well as the parents who are accomplices.” That’s “because some prosecutors question whether it is ‘aggravated assault when the parents and the children consent.'”

This newly worded bill will go to the Senate.

I cant believe there should be any questions if FGM is okay. It's like plastic surgery. If the mom thinks the baby ain't pretty enough, is plastic surgery okay?

I don't care if women do FGM when they reach consensual age and wanna mutiliate their own pussy.

But it should be a clear universal NO for it being done to modify babies.

I am surprised you brought up the subject of plastic surgery on under 18s. During my time at the hospital in Singapore it was considered a normal practice

I don't see anyone defending FGM round here so I'm not sure why we keep manufacturing some big left/right controversy about it. Interestingly it was the left and feminist groups who did most to push for effective laws in the UK, but it's certainly not a left/right issue as the only debate was about how to tackle FGM most effectively and protect children when those carrying it out had a conspiracy of silence.

The upshot is that both doctors and family members have been prosecuted, quite rightly.
