So ... let me get this straight ....

If a man knocks down a woman, beats her senseless and yells at her "you bitch", he might get ... say ... 5 years.

If a man knocks down a homosexual, beats her senseless and yells at her "you dyke!" he might get ... say ... 20 years?

You find this fair, somehow?

I personally feel it's an act of violence, neither example is a lesser or greater degree.  I couldn't care less what was going through the guy's mind when he violated another human being.  Does it really matter?  I don't think so.  Punish for actions not thoughts.

I've never really understood hate crime protections. Maybe that's because I don't go around hating anyone. It's never made sense to me that if I kill someone I get less time if I choose the right words to say during that crime. The result is the same. Someone is dead. I'd rather see all sentences increased than the thought police involved - because that's exactly what this is.

Hate crimes aren`t just intended for individuals.

They are also against the community.

The two male murderers were "homosexual hunting" when they tricked and attacked Shepard and left him to die.

They were attempting to TERRORize the gay community as well as the victim.

For this reason, hate crimes are different and need extra attention.

I am against all hate crime legislation, because it is on it's face projecting that it is fair to be unfair. And that is for the supposed purpose to be fair.

You can't have it both ways. No matter which side of the fence you fall on, any sane person should see the irony, and while I appreciate irony, it has no place in law. Period.

Fair to who?

To anyone.

Is it?

****

And now ... it's all really about "crimes against the community"?

O59; if they killed him, execute them. I have no problem with that. Hunting a person in that manner is an act of a predator who needs to be excised from society.

The one thing I liked about Bush, as Governor of Texas he said "We don't need special laws, we'll execute them", this in reference to the pickup truck dragging death.

We have a perfect right to kill predators among us. We should do it more often. Well then maybe this IS a step in the right direction and I should shut up.

If someone is picked out b/c of their religion ,race or(and now) sexual orientation, that group the individual is from is also targeted and affected.

For the life of me,I can`t figure out we anyone would stand up for the rights of hateful criminals.

Aren`t there some other more worthwhile disparities to fight against?Surely there must be.

But it's ALL hateful.

If you terrorize people in any community, you should pay the price.  If you hunt down and murder anyone of any stripe, you pay the price.  If you want to be a hateful person, and do hateful things, you pay the price for those crimes, for those actions.

Who cares if you hunted and killed because you hated tall brunettes, or hated lesbians, or gays, or blacks, or whites, or crack whores, or band nerds, or whatever.  Shouldn't everyone's life have equal value in this context?. Why should one type of hatred be worse than another?   If one commits murder, he certainly didn't do it out of love.

Anyone who thinks that bin-laden was targeting just the folks in the WTCs and the Pentagon should re-examine what a hate crime is.

They were attacking all of us.

And you explain it to all the mothers whose sons didn't qualify for the enhancement of charges when they were murdered.

So ... uh ... when we catch a terrorist .... maybe we should be extra hard on him. After all, you admit it's a hate crime, right?

I'm going to have to think about this a bit.  Right now, I am leaning against hate crimes.

The government has an unquestionable right to hold us accountable for our actions.  Hate crimes do that, but add on an extra penalty for our thoughts while committing a crime.

I want the government to stay OUT of my head.  The implications of criminal charges for thoughts scares me a lot.

i do not think it is the thought WHILE committing the crime, Steven. Rather i think it is the intent behind the crime.
