In my experience, it is better to be polite. The thing is- when pulled over- the motorist often can be issued more then one ticket. Why make life harder?

There are times when my outbursts are mistaken as rage- and it is more frustration onto myself.     I don't want to be tazed.    But nor will I blab away to enable getting an extra fine.

I've got quite a ticket history, personally. It's not an "official" history, of course, because my lawyer makes them all 'go away' in some way or another.

However, the closest I came to being arrested was when a cop pulled me from my car because after asking me why I did what he claimed I did, my reply to him was that we would discuss it in court. That was apparently enough to set him off but as I shut my yap after that, he eventually let me go on my way with 3 tickets for my trouble. The funniest part was that, while most of my tickets are "made to go away" by way of deferred adjudication fines or something similar....the three tickets from that particular stop were dismissed out-right. Though I said we could discuss my alleged infraction in court, apparently the cop didn't care to, as he didn't show up.

Lawyers dont work for free.  So her talk of sueing is mute.

No, but there are many who will work for the promise of getting paid with a portion of the settlement money. I've heard scores of commercials that say "we don't get paid unless you do." Now whether one of those types will take the case is an entirely different matter.

*wonders how many people who have posted to this thread were there*

I have written many citations, as well as taken many to jail in my near 20 year career.....but that ended several years ago for me

I'd have to see the dash cam tape (the story said there is one) to make a call one way or another. Having said that I don't think there should be any age limit on tasering. There are plenty of senior citizens capable of getting out of hand when they want to. Granny doesn't look all that frail to me.

I second these notions.

She didn't look that frail to me either. In fact, watching her on the video, she looks pretty feisty. I'm wondering, though, why the dash cam footage hasn't been released. Too soon, maybe?

ShaharThorne -> RE: Granny tasers in TX~! (6/2/2009 5:12:36 PM)

Dash cam video is considered evidence until date of the trial. Hence we will not see it unless we get to go to court or see it on Tru TV.

In the event that I beleive he acted properly- I will apologize to the cop.

The article could be more complete.  On that- I agree.

It's time. The dash cam's out. I await your apology to the cop.

Here's a tip for the future: Never judge a story like this strictly on the age of the offender. David Carradine was 72 and still practicing martial arts and making movies. Age is irrelevant. Arnold is almost 70. You going to say he can't cause some trouble?

My second tip is for news items....it's best to let the real, FULL story come out before you cry out to tar and feather the cops. It's funny, when someone gets arrested in this country, people all over the place scream out "innocent until proven guilty" yet they never say the same thing when it's suggested that a cop has done something wrong. They always just assume the cop is in the wrong. So sad that we hold these public servants up to a higher standard than standard citizens such that they can't be given the same due process that we demand for ourselves.

Loki45 -> RE: Granny tasers in TX~! (6/10/2009 9:26:51 AM)

Another interesting thing to note in this case is that, before the dash cam footage came out, she was more than happy to go on camera, proclaim her mistreatment at the hands of the cop and demand justice.

Now that the footage has been released, she's strangely unavailable for comment. Funny that. Granny must not have heard about these new fangled movin' picture cameras in the police cars these days.

ShaharThorne -> RE: Granny tasers in TX~! (6/10/2009 9:48:13 AM)

I finally saw the footage last night on the local news and she was quite fiesty and arguemetive(?). Usually when I get that way with the police they help calm me down which was what I saw the constable doing.

Exactly. He was trying to calm her down, keep the both of them out of traffic and diffuse the situation. She, on the other hand, was throwing her age out repeatedly, daring him to arrest her, daring him to tase her, slapping away when he went to cuff her.

You can only give someone so many chances and warnings. The talk radio guys up here said "she would have been frying like bacon by now if I were the cop." The same guys last week were saying what others in this thread were saying -- "Seriously, he can't handle a 72-year- old woman?"

Funny how things change when the facts are known, isn't it?

Asherdelampyr -> RE: Granny tasers in TX~! (6/10/2009 10:48:38 AM)

Is there a link anywhere to the dash cam footage? if it was on TV it should be on the internet by now

EDIT: I found it :)

Ok, I have to know, how much of a threat is a 72 year old lady? I know that they got them bony fingers, but other than that...

I understand the right of a cop to use any tool at his disposal, it just seems odd.

Is this true? Is there not suposed to a consideration toward necessity?

Kim

They have the right, in theory to use all the neat toys they get when they are assigned
It is thier training that tells them when it is neccissary to use those toys.

What I was saying here is that I cannot in good concience without any real info other than a she said he said thing say that the officer didnt have a right to use a tool issued by the police force.

re-read the story looking for a vid link and stumbled upon this, which made me laugh

""It's unreal. It's like an electric shock," she said."

Irishknight -> RE: Granny tasers in TX~! (6/10/2009 12:50:52 PM)

It looks to me like she thought she didn't have to listen to the officer and that he "couldn't do anything to her."  Hopefully, she learned a valuable lesson or even two.  Don't resist arrest would be a good one.  Maybe she might even learn that the law applies to her just like the rest of us.

Asherdelampyr -> RE: Granny tasers in TX~! (6/10/2009 12:52:15 PM)

If I was the officer I would have been worried, from the way that she was acting, that she may hurt herself, like run into traffic. I mean, she didnt seem to have any regard for well, anything.

pahunkboy -> RE: Granny tasers in TX~! (6/10/2009 1:06:11 PM)

The Police department.  I have a question.  I looked at the cam link.   Why did he go to the driver door?   This was a busy dangerous road.  In PA the cop goes to the passenger window when those conditions are met.

The cop DID warn her about being tazed- more then once- so even if her hearing was off- she had ample warning.    Anytime there is a lawsuit no one talks to the media.

If I were the judge- I would give the lady an extra ticket for disorderly conduct - and the speeding.  I also would have the PD revise the policy to more like PA policy.  The officers body WAS shielding her from a potential car hit.

I dont think I would reprimand the cop.  But the approach of the driver window vs the passenger window is crucial in this event.  The arresting officer does not set policy and he did verbally warn her 5 times.

-->  Therefore I apoligise to the cop.

I do take issue with the PD policy and think the lady could still have a lawsuit.     A dangerous road- going to the driver door.  stupid.

I have to say that the officer clearly telling her he would taze her has impacted my opinion here.   ...and if you think about it 2 dead bodies could be lying on the highway due to the lady throwing a temper tantroom cause she got caught.   Hey- I got caught.  You probably got caught.  We took our lumps with out incident.

I also suspect that an upscale area-   well- the locals tend to be pompous and arrogant.   So- the cop acted in a fair way- particularly since they both could have been road kill.
To the cop;  I am sorry.

I think the reason he may have gone to the driver side door is because it seemed rather loud, and it was a larger truck, perhaps he did not think he would be able to give her the ticket, or even communicate from the other side?
merely conjecture, mind you.
