...not what i meant, but i suspect you knew that.....

Force of arms is one thing, it can be done without compromising ones principles.  However, force of arms combined with compromising ones principles is an insidious combination. It damages the perpetrator as much as its intended target.

...the right to a fair trial, to know the charges against one, to be able to prepare a defence against those charges, to face your accuser, to not be found guilty on hearsay evidence have all been part of Western Nations philosophy for a couple of centuries or more. Why? How did such an apparent consensus arrive? Perhaps because it is self evidentally fair...clearly just....obviously the correct way for a state to behave in respect of individuals. Gitmo is a throwback to a primitive and short sighted idea of justice. One proven by centuries of experience and countless examples to be a failure.

Yep, that's why we shouldn't have taken prisoners at all. Then gitmo wouldn't even be an issue.

      Law of unintended consequences.  We tried to be merciful to enemies we had in the sights of our weapons, and look where it landed us...

Exactly.  We should be following the "Cobra Kai" laws of combat. "If a man faces you he is the enemy....an enemy deserves NO mercy!"
